RESOLUTION N0. s~' 93

WHEREAS, Stephen K. Yamashiro has been duly elected as the
Mayor of the County, has duly taken office as the Mayor, and
has exercised the power and duties of the Mayor since
December 7, 1992; and
WHEREAS, Section 5-1.3 of the County Charter provides
that, except as otherwise provided by the County Charter, the
Mayor shall be the chief executive officer of the County vested
with all the executive powers of the County and the Mayor shall
have the power, among other powers, to exercise direct
supervision over all agencies of the County; and
WHEREAS, Section 5-3.1 et.seq. of the County Charter
provides that the Director of Finance shall be appointed by the
Mayor, confirmed by the County Council and may be removed by
the Mayor, and further sets forth the various powers and duties
of the Director of Finance; and
WHEREAS, the Mayor has stated his intentions to appoint
but has not yet appointed a Director of Finance, and, in the
absence of such appointment, the Mayor has acted as and has
fully and faithfully exercised and discharged the duties and
responsibilities of the Director of Finance in his capacity as
Mayor since December 7, 1992;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
COUNTY OF HAWAII that:
1. It is hereby approved and confirmed that, until a
Director of Finance has been appointed by the Mayor and
confirmed by this Council, the duties and responsibilities of
the Director of Finance shall be exercised and discharged by
the Mayor in his capacity as Mayor.
2. All actions taken by Stephen K. Yamashiro as the
acting and temporary Director of Finance in his capacity as
Mayor since December 7, 1992, including without limitation, the
execution and delivery of all contracts and instruments,
Resolution 49-93, Draft 2, and all terms and provisions of the
bonds and the issuance and sale of the bonds under and pursuant
to Ordinance Nos. 93-43 and 93-94, and the bond purchase
contract for said bonds submitted to the Council at the meeting
at which this Resolution is adopted, are hereby approved,
confirmed and ratified.
