RESOLUTION N0. 99 93
RESOLUTION AUTHORIZING THE MAYOR OF THE COUNTY OF HAWAII TO
EXECUTE LOAN DOCUMENTS RELATING TO THE PAPAIKOU COLLECTOR SYSTEM.
WHEREAS, the residents of the Papaikou community need to have
the existing plantation sewer system, owned by C. Brewer
Properties, upgraded to meet County of Hawaii standards; and
WHEREAS, the community and C. Brewer Properties, in order to
carry out this upgrade, which will be known as the Papaikou
Collector System, have agreed to apply for a loan and grant from
the Rural Development Administration (RDA), a federal agency; and
WHEREAS, this loan and grant will cover 75$ of the total cost
of the Papaikou Collector System project, with the remaining 25$
of the cost being provided from State and County funds; and
WHEREAS the RDA wishes to make the loan and grant with the
County of Hawaii rather than the Papaikou Community Association
because of the County's experience in the area of loan/grant
application and financing; and
WHEREAS, C. Brewer Properties has agreed to repay the loan;
and
WHEREAS, §46-7 of the Hawaii Revised Statutes provides that
the governing body or the planning commission or department of the
various counties, with the consent of the County Council, may
enter into agreements with the federal government or other bodies
respecting action to be taken pursuant to any powers granted to it
by law and furnish, expend and receive any funds or other
assistance in connection with projects being or to be undertaken
pursuant to the powers.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that the Honorable Stephen K. Yamashiro, Mayor of the
County of Hawaii, is hereby authorized and designated to sign in
the name of the County of Hawaii such application forms and other
documents for construction loan and grant benefits from the
appropriate Federal agency for the Papaikou Collector System in
South Hilo, County of Hawaii, State of Hawaii.
BE IT FURTHER RESOLVED that the Chief Engineer be designated
as the authorized representative to receive all communications.
BE IT FURTHER RESOLVED that the County Clerk be hereby
directed to forward a copy of this resolution to any interested
government or governmental agency.
