HomeMy WebLinkAboutRES 120 Draft 01 1992-1994COUNTY OF HAWAII STATE OF HAWAII RESOLUTION N0. 12d 93 AMENDING SECTION 3, ENTITLED "COMMITTEE CHAIRPERSON," OF RULE 4 OF THE RULES OF PROCEDURE OF THE COUNCIL OF THE COUNTY OF HAWAII RELATING TO COMMITTEE CHAIRPERSONS. WHEREAS, the County of Hawaii has closed the Kealakehe sanitary landfill and has now opened the new Pu'uanahulu sanitary landfill in West Hawaii under a private contract which provides for payment of substantial tonnage fees for solid waste deposited with the contractor for landfilling; and WHEREAS, the County of Hawaii has not adopted an ordinance or plan to reduce the volume of solid waste to be landfilled in West Hawaii or in any other region within the County, whether through source reduction, diversion or recycling; and WHEREAS, just within recent weeks the Mayor has presented a proposed solid waste management plan to the Council, but such plan is devoid of specific program proposals to implement the draft plan objectives; and WHEREAS, the Council recognizes the emergency of a solid waste disposal crisis now upon this county and that a programmatic solid waste management plan for the County of Hawaii is urgently needed in order to actually reduce and manage the volume of solid waste being disposed at county landfills; and WHEREAS, a programmatic solid waste management plan must be finalized and adopted by the Council for the County of Hawaii as soon as possible, and such endeavor must be given emergency status and take precedence over non-essential Council business. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that section 3, entitled "Committee Chairperson," of Rule 4 of the Rules of Procedure of the Council of the County of Hawaii is hereby amended to read: "3. Committee Chairperson The chairperson of each committee shall call meetings, preside at all meetings and prepare and be responsible for their respective agenda for each meeting. The vice-chairperson shall perform the duties of the chairperson in his/her absence. The committee chairperson of each committee shall receive all referrals to the committee. The referrals shall be placed on the agenda of the committee upon the request of any councilmember, whereupon the committee chairperson shall schedule the matter within the next two committee meetings after such request. Provided, however, the committee chair erson or vice-chair erson shall not schedule anv referral onto anv meeting agenda occurrin during the months of November or December of 1993 unless, in the discretion of the chairperson or vice-chairperson of the committee or council, such referrals re ards an immediate and ur ent need or concern of the Count of Hawaii. An "immediate and urgent need or concern" shall include, by wa of illustration only and without limitation: civil emergencies, financial transfers, a ency requests for council approval or comment, significant amendments or adr3;r the Hawaii Count Code, and matters pertaining to development and implementation of a county solid waste management plan and program Provided further, the above requirement to restrict committee agenda shall earlier expire in the event and at such time that a ro osed county solid waste management plan and program is scheduled on council meeting agenda during the months of November or December of 1993."
