RESOLUTION RELATING TO THE CONSTRUCTION OF PERMANENT IMPROVEMENTS TO
THE KONA COASTVIEW AND KONA WONDERVIEW SUBDIVISIONS IN NORTH KONA,
COUNTY OF HAWAII, INCLUDING THE IMPROVEMENT OF THE WATER
DISTRIBUTION SYSTEM TO COUNTY STANDARDS, IN ACCORDANCE WITH
CHAPTER 12 OF THE HAWAII COUNTY CODE RELATING TO IMPROVEMENTS BY
ASSESSMENTS.
WHEREAS, it has been brought to the attention of the Council of
the County of Hawaii that the water distribution systems for the
Kona Coastview and Kona Nonderview Subdivisions, located in North
Kona, County of Hawaii, are not built to County standards; and
WHEREAS, pursuant to Chapter 12 of the Hawaii County Code, the
Council may initiate an improvement district to improve this
shortcoming; and
WHEREAS, the first requirement of creating such a district is
for this Council to direct the Chief Engineer to investigate various
aspects of the project.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the Chief Engineer is hereby directed to prepare and
submit to the Council a report containing the following:
(1) Preliminary data concerning the special improvement
proposed to be constructed;
(2) The general character and extent of any improvement to be
proposed;
(3) The proposed method of assessment whether on a frontage,
area, or other basis;
(4) Whether any new land will be necessary to be acquired, and
the estimated cost thereof, and the proportion of the cost which
should be borne by the County;
(5) The materials recommended to meet conditions of improvement;
(6) The boundaries of the proposed improvement district and any
subdistricts and zones therein as to which different portions of the
cost of improvements should be charged;
(7) The estimated cost of the improvement, the portions of-the
cost to be borne by the County, and the portions of the costs to be
assessed against the lands specially benefited with the maximum unit
of assessment to be made against each lot to be assessed; and
(8) All necessary plans and other data, details, and
specifications for the improvements and any other matters or details
intended to apply thereto.
BE IT FURTHER RESOLVED that the County Clerk is hereby directed
to furnish copies of this resolution to Mayor Stephen K. Yamashiro,
Chief Engineer Donna Fay K. Kiyosaki, and to Department of dater
Supply Manager William Sewake.
