RESOLUTION RELATING TO THE CONSTRUCTION OF PERMANENT IMPROVEMENTS
TO THE KONA OCEAN VIEW SUBDIVISION IN NORTH KONA, COUNTY OF
HAWAII, INCLUDING IMPROVEMENT OF THE ROADWAY TO COUNTY DEDICABLE
STANDARDS AND INSTALLATION OF A WATER SYSTEM, IN ACCORDANCE WITH
CHAPTER 12 OF THE HAWAII COUNTY CODE RELATING TO IMPROVEMENTS BY
ASSESSMENTS .
WHEREAS, it has been brought to the attention of the Council
of the County of Hawaii that the residents of the Kona Ocean View
Subdivision, located in North Kona, County of Hawaii, have
requested the installation of a water system and improvement of
the roadway to dedicable standards; and
WHEREAS, in order to construct the necessary improvements,
this Council may initiate improvement districts to accomplish this
task through improvement by assessments,-as authorized by Hawaii
County Code, Chapter 12; and
WHEREAS, the first requirement of creating such a district is
for this Council to direct the Chief Engineer and the Manager of
the Department of Water Supply to investigate various aspects of
the project;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the Chief Engineer is hereby directed to prepare and
submit to the Council a report containing the following
information:
(1) Preliminary data concerning the roadway improvement
proposed to be constructed;
(2) The general character and extent of any improvement to be
proposed;
(3) The proposed method of assessment whether on a frontage,
area, or other basis;
(4) Whether any new land will be necessary to be acquired,
and the estimated cost thereof, and the proportion of the cost
which should be borne by the County;
(5) The materials recommended to meet conditions of the
improvement;
(6) The boundaries of the proposed improvement district and
any subdistricts and zones therein as to which different portions
of the cost of improvements should be charged;
(7) The estimated cost of the improvement, the portions of
the cost to be borne by the County, and the portions of the cost
to be assessed against the lands specifically benefited with the
maximum unit of assessment to be made against each lot to be
assessed;
(8) All necessary plans and other data, details, and
specifications for the improvements and any other matters or

Additionally, the Chief Engineer is directed to furnish to the
Department of Water Supply such copies of surveys, maps and plans
as may be necessary for the water department to prepare final
plans for the water system.
BE IT FURTHER RESOLVED that the Manager of the Department of
Water Supply is hereby directed to prepare and submit to the
Council a report containing final details, plans and
specifications for such water system for the proposed subdivision.
BE IT FURTHER RESOLVED that upon completion of these reports,
the Chief Engineer and the Manager of the Department of Water
Supply shall submit them to this Council.
HE IT FURTHER RESOLVED that the County Clerk is hereby
directed to furnish forthwith the Mayor, the Chief Engineer, and
the Manager of the Department of Water Supply with copies of this
resolution.
