COUNTY OF HAWAII STATE OF HAWAII
RESOLUTION
WHEREAS, the Hawaii County Police Department has a practice of
keeping some names of people arrested secret, and;
WHEREAS, the Hawaii Tribune Herald took the issue to Court,
and;
WHEREAS, Circuit Court Judge Greg Nakamura ruled in favor of
the Newspaper, and;
WHEREAS, the Hawaii County Police Department said it is
planning to appeal this decision to the State Supreme Court, and;
WHEREAS, keeping arrest records secret violates the
fundamental principle of protection of freedom of American
Citizens, and;
WHEREAS, Hawaii County is the only place in the U.S. where
this practice happens and;
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it directs the Corporation Counsel to accept the
decision of the Circuit Court and not appeal this case, and;
BE IT FURTHER RESOLVED that copies of this Resolution be sent
to the Mayor, Corporation Counsel and the Chief of Police.
