RELATING TO ESTABLISHING CRITERIA FOR WATER CATCHMENT SYSTEMS TO
ALLOW FOR THE ZONING OF LANDS IN URHAN DESIGNATED AREAS WITHOUT THE
NECESSARY INFRASTRUCTURE FOR WATER.
WHEREAS, the availability of water is a necessary and a
significant component in the planning and zoning for the County of
Hawaii; and
WHEREAS, there are areas on the island of Hawaii designated as
urban where the development of ground water *esources and systems
are severely restricted by uncertain and uncontrollable development
costs; and
WHEREAS, smaller developments within these urban designated
areas are incapable of funding the infrastructure necessary for the
development of water and its on-site and off-site improvements; and
WHEREAS, in areas with adequate rainfall, domestic water has
been traditionally provided by the use of individual water catchment
systems.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that all of the following criteria are established for water
catchment systems in order .to allow for the zoning of parcels in
areas designated as of the date of adoption of this resolution as
urban where a water source is not available through a public or
private water system meeting the requirements of the Department of
Water Supply:
(1) The area of the request has no municipal or private water
system meeting the requirements of the Department of Water
Supply and there are no plans to construct such a system;
(2) The General Plan of the County of Hawaii designates the
area of the request as Low or Medium Density Urban, but
shall not include areas designated for future Urban
Expansion;
(3) The State Land Use designation for the area of request is
Urban;
(4) The request is part of an existing development for which
the proposal is an integral part of the existing
development and proposes the same use;

(5j There is more than adequate rainfall available in the area
of the request based on a formula using the median annual
rainfall and daily usage of gallons per day;
(6) The water catchment systems and storage capacity shall meet
with the requirements of thelStand DheaFirenDepartmenth~
the Department of Water Supp y
(7) All of the above criteria shall be met to allow zoning of
parcels in urban designated areas.
BE IT FURTHER RESOLVED that the Council of the County of Hawaii
directs the Planning Director and the Planning Commission to
implement the above criteria for the processing of those zoning
requests meeting the above criteria and to establish minimum
standards for the capacity of water catchment and storage capacity
based on the proposed use, rainfall and catchment area.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
transmit copies of this resolution to the Mayor of the County of
Hawaii, the Planning Director and the Planning Commission Chairman.
