HomeMy WebLinkAboutRES 278 Draft 01 1992-1994COUNTY OF HAWAII STATE OF HAWAII RESOLUTION N0. 278 94 RESOLUTION AUTHORIZING THE COUNTY OF HAWAII TO ENTER INTO CONTRACT NO. HA-95-2-A WITH THE EXECUTIVE OFFICE ON AGING, OFFICE OF THE GOVERNOR, STATE OF HAWAII, PURSUANT TO H.R.S. §46-8, WHEREBY THE STATE OF HAWAII PROVIDES FUNDS TO THE COUNTY OF HAWAII OFFICE OF AGING TO MAINTAIN PROGRAMS RELEVANT TO THE NEEDS OF THE ELDERLY. WHEREAS, Chapter 42D, Hawaii Revised Statutes establishes the qualifying standards and conditions relating to the receipt of funds contained in this chapter and under section 42D-11(b) provides that the Standards and Conditions shall not apply to funds that are transferred from one governmental agency to another governmental agency, including county agencies; provided that, if the receiving agency in turn contracts with a recipient or provider, then the qualifying standards and conditions and other provisions of this chapter shall apply to the recipient or provider and the contract. The receiving agency shall ensure compliance by the recipient or provider; WHEREAS, the STATE, pursuant to Chapter 349, Hawaii Revised Statutes, is mandated to develop and implement health, education, recreational and cultural programs for elderly persons; and to develop and implement active programs of consumer protection and pre-retirement counseling; and to provide technical assistance and liaison for the purpose of establishing elderly controlled local service delivery systems providing comprehensive services and employment opportunities for the elderly throughout the State; WHEREAS, under the Older Americans Act of 1965, as amended, 42 U.S.C. §3001 g~ sea., and the rules adopted pursuant thereto, 45 C.F.R. Chapter XIII, part 1321, the Executive Office on Aging is responsible for overall coordination of activities in the State of Hawaii relating to elderly persons; WHEREAS, the COUNTY OF HAWAII by and through its agency, Hawaii County Office on Aging is the agency designated by the STATE as the area agency on aging responsible for developing an area plan for a comprehensive and coordinated system of services for elderly persons in the County of Hawaii; WHEREAS, on the basis of the COUNTY OF HAWAII's past performance as an area agency on aging, the STATE believes that it is appropriate for the COUNTY OF HAWAII to expend a portion of said funds by contracting with the private organizations and public agencies as set forth in Attachment 1, within the area of the COUNTY OF HAWAII to assist the STATE in satisfying its responsibilities under Chapter 349, Hawaii Revised Statutes, and the Older Americans Act of 1965; WHEREAS, the STATE has funds available to fund Contract No. HA-95-2-A pursuant to Act 289, S.L.H. 1993, the Seventeenth Legislature in the amount of $858,309.00. WHEREAS, pursuant to Chapter 42D, Hawaii Revised Statutes, and Chapter 349, Hawaii Revised Statutes, the STATE is authorized to enter into Contract No. HA-95-2-A. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the Honorable Stephen K. Yamashiro, is hereby authorized and designated to sign in the name of the County of Hawaii the above-noted Contract No. HA-95-2-A. BE IT FURTHER RESOLVED that the County Clerk is hereby directed to forward copies of this resolution to the Honorable Stephen K. Yamashiro, Mayor of the County of Hawaii, the Executive Office of Aging, Office of the Governor, State of Hawaii, the County of Hawaii Office of Aging, and to any other interested government or governmental agency.
