RESOLUTION N0. 284 94

WHEREAS, expansion of County services in West Hawaii have
resulted in a number of facilities being leased in various
locations at great expense to the County; and
WHEREAS, the situation of scattered office locations of our
public service agencies are not conducive to public convenience
nor government efficiency; and
WHEREAS, the County desires to consolidate its West Hawaii
operations by acquiring an interim office facility to centrally
locate as many of its West Hawaii County services as possible; and
WHEREAS, the County has issued Request For Proposal No.
1500 for such a facility and has received proposals which provide
the County with the opportunity to acquire a facility with a
guaranteed repurchase price after six years; and
WHEREAS, under the terms and provisions of RFP 1500, the
sale of the facility under the guaranteed repurchase provision
would not be in accordance with provisions of Sections 2-112,
2-113, 2-114 and 2-115 of the Hawaii County Code; and
WHEREAS, Section 2-112, Hawaii County Code, provides that
the Council may authorize the disposition of real property in some
other manner than public auction if it finds substantial reasons
to do so.
NOW, THEREFORE, HE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that any Contract includes provisions that an exercise
of any option to repurchase shall be subject to Council approval.
BE IT FURTHER RESOLVED that the Council of the County of
Hawaii finds that the benefits to be derived from the
aforementioned provide substantial reasons to allow the
Administration to negotiate a contract to acquire a West Hawaii
facility requiring the payment of funds from an appropriation of a
later fiscal year which contract shall be presented to the Council
for approval.
BE IT FURTHER RESOLVED that the Council, pursuant to
provisions of Section 10-11 of the Hawaii County Charter approves
the obligation to acquire a West Hawaii facility requiring the
payment of funds from an appropriation of a later fiscal year.
BE IT FURTHER RESOLVED that copies of this resolution be
transmitted to the Honorable Stephen K. Yamashiro, Mayor of the
County of Hawaii.
