A RESOLUTION RELATING TO CONVERSION OF COUNTY-OWNED ROAD
REMNANTS INTO ROADSIDE PARKS.
WHEREAS, Hawaii Revised Statute 264-1 states that any public road not listed as a state
or federal-aid highway under the jurisdiction of the Department of Transportation shall be
considered a County road until vacated, closed, abandoned or discontinued; and
WHEREAS, pursuant to the Section 2-111 of the Hawaii County Code 1983, the County
Council may, by Resolution approved by a majority of its members, direct the Chief Engineer or
Finance Director to dispose or real property in fee simple; and
WHEREAS, County-owned road remnants being considered for sale or abandonment
may potentially be better utilized as public pazk azeas; benefitting the residents of the community
as well as visitors to the County of Hawaii.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE COUNCIL OF THE
COiJNTY OF HAWAII that prior to offering for sale any road remnant, the mayor shall provide
the Council with an assessment of the suitability of such remnant for conversion into a roadside
or linear pazk or open-space reserve. Unless such remnant is approved by this Council for
disposition, it shall be reclassified as pazk land on the County's inventory of real property and
managed appropriately.
BE IT FURTHER RESOLVED that for such roadside pazks, the County of Hawaii
request from the Courts that persons sentenced to perform community service be utilized to
maintain such pazks.
BE IT FURTHER RESOLVED that the County institute an "adopt-a-park" program
where community groups would make needed improvements to these roadside pazks by planting
trees, landscaping, providing portable restroom facilities and picnic tables, and overseeing the
maintenance.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies of
this Resolution to the Honorable Stephen K. Yamashiro, Mayor of the County of Hawaii, Mr.
George Yoshida, Director of the Department of Pazks and Recreation, and Ms. Donna Kiyosaki,
Chief Engineer of the Department of Public Works.
