RESOLUTION N0. 323 94
WHEREAS, Chapter 2, Article 9, of the Hawaii County Code
provides that the County Council may, by resolution
approved by a majority of its members, dispose of real
property; and
WHEREAS, an easement and right-of-way was granted to the
County of Hawaii on August 29, 1928, for parcel T:~fIC:
2-7-05:08 for the purpose of clearing, trenching, laying,
construction, maintaining and repairing of a pipeline for
a water system for the County of Hawaii; and
WHEREAS, the Department of Water Supply no longer needs
the easement and right-of-way due to water system
improvement, and therefore, would like to terminate the
easement and right-of-way; and
WHEREAS, the Corporation Counsel has determined that
appraising the parcel is unnecessary; and
WHEREAS, Mr. Takeshi Wagatsuma, Trustee of the Takeshi
Wagatsuma RLT (the present owner) will accept the
cancelled easement and right-of-way with the understanding
that the pipeline will be abandoned in place;
NOW, THEREFORE, BE IT RESOLVED by the Council of the
County of Hawaii that:
1. In accordance with the provisions of Chapter 2,
Article 9, of the Hawaii County Code, the Director of
Finance be authorized to cancel the easement and
right-of-way, for parcel TMK: 2-7-65:08 located at
Papaikou, Hawaii.
The Clerk of the County of Hawaii transmit copies of
this resolution to Mr. Takeshi Wagatsuma, Department
of Water Supply and the Director of Finance.
