RESOLUTION N0. 325 94
A RESOLUTION AMENDING THE AMENDED URBAN RENEWAL PLAN FOR THE KAIKO'O
PROJECT N0. HAWAII R-4.
WHEREAS, Mauna Kea Holding Company, Inc. is proposing to
renovate the building known as the "Ice House," located on a 29,489
square foot parcel of land, situated along Banyan Drive and adjacent
to the Liliuokalani Gardens in South Hilo, Hawaii, designated by Taz
Map Key 2-1-3:24 and portion of 23 (hereinafter, the "Property"); and
WHEREAS, the Property is located within the boundaries of the
Project Area designated under the Amended Urban Renewal Plan for the
Kaiko'o Project No. Hawaii R-4, hereinafter the "Urban Renewal
Plan", and is subject to the conditions in the Urban Renewal Plan;
and
WHEREAS, an amendment to the Urban Renewal Plan is required for
the proposed uses and the renovation for the Ice House which include
the construction of a second story addition consisting of a
restaurant, banquet facilities, and a commemorative museum and the
construction of a three story addition to the north side of the
ezistinq building with covered parking on the ground level,
commercial office space on the second level and five (5) residential
apartments for transient accommodations on the third floor; and
WHEREAS, Section 53-6 of the Hawaii Revised Statutes permits the
amendment of any redevelopment plan by Council resolution; and
WHEREAS, The Council of the County of Hawaii finds that the
amendment of the Urban Renewal Plan for the proposed project would
further enhance the surrounding area;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the Urban Renewal Plan for the Kaiko'o Project, Project
No. Hawaii R-4 is hereby amended as follows:
1. The designation for the Property on the Land Use Map,
Ezhibit II-B, is redesignated from "Open Uses" to Limited
Industrial Uses."
2. Section C.2.a(2)(b) is amended to read as follows:
(b) Limited Industrial Uses. The only industrial uses
permitted within the Project Area shall be the Honolulu
iron Works operations and the commercial fishing and
related activities and operations such as storage, auction,
ice plant, moorage, boat drydock, service and repair and
commercial fishing suppliers in locations specified
therefor on the Land Use Map. Certain incidental
commercial uses such as seafood restaurant, sport fishing
suppliers and other such "fisherman's wharf" type
activities and uses shall be permitted within the fishing
industry area, and equipment sales, display and
merchandising activities shall be permitted within the
Honolulu Iron Works industrial area. In addition, office
use and transient residential uses in the area are
provisions.
Section C.2.a(5)(b) is amended to read as follows:
(b) Prohibition Against Residential Uses. No residential
uses, of any kind, including single-family residential or
multiple apartment residential, shall be continued or
permitted in any part of the Project Area, whether elevated
or otherwise, during the effective covenant period for this
project, but the foregoing prohibition shall not affect nor
preclude hotel, motel, or other transient residential or
housing facilities from being located in the elevated areas
within the project or in open areas within the proiect when
wave-resistant standards required by the applicable
provisions of the county code."
4. New Material in the Urban Renewal Plan is underscored.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
transmit true copies of this Resolution to Mayor
Stephen K. Yamashiro and Planning Director Virginia Goldstein.
