Re: Res. 77-89 COUNTY OF HAV16,A `:.:STATE OF HAWAII ,.; RESOLUTION No, ~~' 88 (.DRAFT 2) bdHEREAS, several specific parcels of land within Waikoloa Village Subdivision were set aside and designated as neighborhood park sites and conveyed to the County by ordinance during initial subdivision approval; and WHEREAS, the increased resident population in the subdivision has created an urgent need to furnish and equip these sites with recreational facilities as originally intended; and WHEREAS, the Waikoloa Village Association, knowing that the County is not presently in a financial position to provide these improvements, has considered developing and maintaining one park site in the community on a self-help basis; and WHEREAS, the Waikoloa Village Association proposes to purchase, build, and maintain one of these sites identified by TMK: 6-8-13:01 as a public park with the understanding that it would be used exclusively for public recreational purposes; and WHEREAS, a negotiated sale of this parcel can be made to a buyer who intends to create a public park, open to all, providing, however, that in the documentation a reversion clause would be included stating that the parcel would revert back to the County if public park use was not maintained. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it agrees that the public interest would best be served by having the County of Hawaii sell the land identified by TMK: 6-8-13:01 to the Waikoloa Village Association, a non-profit group, by the process of negotiation as allowed in Section 2-114 of the County Code, so that this Association may proceed with their plans to build and maintain a public park, open to all. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies of this resolution to Mayor Bernard Akana, Finance Director Barry Mizuno, and Director of Parks and Recreation Larry Tanimoto.
