WHEREAS, the Hawaii County Council is charged with the primary responsibilities of legislation and public policy formulation; and [v'HEREAS, the exercise of these powers is possible under the Hawaii State Constitution and the laws of the State of Hawaii; and YJHEREAS, through the course of performing its duties, the Council may find it desirable to attempt a change to the laws of the State which reflect the interest of Hawaii; and IJHEREAS, the Council's Legislative Procedures are meant to provide an implemental framework to effectuate those legislative considerations and reform. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the attached HAWAII COUPITY COUNCIL'S LEGISLATIVE PROCEDURES is hereby adopted to implement the legislative duties of the Council. Legislative Proposals: Preparation A. The Inter-Governmental Relations Committee will solicit ideas for legislative proposals for annual convening of the Hawaii State Legislature. Proposals must be submitted in writing. B. Proposed bills/concepts from Councilmembers and the Mayor shall be forwarded to the Inter-Governmental Relations Committee for preliminary discussion. II. Legislative Proposals: Approval A, Upon receipt of a proposal, the Inter-Governmental Relations Committee may: la. Approve the proposal in whole or in part. b. Request necessary legal draft preparation by Corporation Counsel and/or Legislative Auditor. c. Transmit the proposal to the Legislative Auditor's office for comment. d. Determine whether the proposal should be included within the HSAC Legislative Package or the Hawaii County Legislative Package. 2. Defer for further study. 3. Reject the proposal, B. Conceivably, a proposal could be included in one of the following: - 1 - 1. HSAC 2, Administration - Proposed bills proffered by the Administration. 3. Council's Legislative Package - Proposed bills or lists of projects approved by a majority vote of the Council. 4. Individual Councilmembers - A proposal that has been rejected by HSAC, Administration and the Council may be lobbied for by an individual councilmember provided the proposal is submitted in the name of that councilmember and does not conflict with the legislative objectives of HSAC and Hawaii County, C. The Inter-Governmental Relations Committee may schedule additional meetings thereafter for the purpose of furthering the Legislative Package. D, The Inter-Governmental Relations Committee Chairperson shall set and transmit the final deadline date for proposal submittal. III, Legislative Proposals: Submittal A. Hawaii State Association of Counties (HSAC) - The Council shall transmit the approved legislation to the HSAC Executive Committee for disposition. - 2 - B. County of Hawaii - Big Island's State legislators will be formally contacted by the Inter-Governmental Relations Committee Chairperson or delegated Councilmember(s) to furnish assistance for the County Council's Package during the session. The Council may also, in joint sponsorship with the Administration, organize a meeting with State legislators of the Big Island prior to the opening of the session for the purpose of presenting the County's package and ensuring program support. IV. Lobbying A. Hawaii County Council's Legislative Package 1. Lobbying team. The lobbying team shall consist of the Council Chairperson and the IGRC Chairperson or any person designated by them. a. Testimony and a summary report or travel requisition shall be filed with the Legislative Auditor's office. b. The results of lobbying efforts should be conveyed in writing to the IGRC Chairperson within two weeks after the testimony is presented. 2. A councilmember may lobby for those measures of special interest to that member which are included in the Hawaii County Council's Legislative Package in the following manner: - 3 - a. A request to present testimony shall receive approval from the Inter-Governmental Relations Committee Chairperson ar,d/or the Council Chairman. b, In order to stay abreast of all personal lobbying efforts, the results of one's efforts should be conveyed in writing to the Inter-Governmental Relations Committee Chairperson within two weeks after the testimony is presented. 3. If any lobbying effort entails the use of county funds (transportation, per diem, etc.), a summary report shall be put on file. The summary report should include date, type of lobbying, to whom the lobbying was done and the subject matter. B. HSAC Legislative Package - Procedures shall be established and implemented by the HSAC Executive Committee. V. Coordination During the Legislative Session A. The Legislative Auditor's office will serve as a repository for legislative resource materials. The progress of a specific bill may be monitored at the written request of any councilmember. Journals of all legislative materials issued by the Senate and House will be kept. These will contain: (1) committees and membership, (2) order of the day, (3) committee referrals, (4) hearing notices arranged by committees, - 4 - (5) transcription of Senate floor proceeding. Legislative digest of measures which have county impact or which have beer, designated by Councilmembers for monitoring will be kept in a separate journal available for review and distributed to councilmembers. A tracking log of bills introduced will also be kept which reflects the bill number, title, committee referrals, hearing dates, disposition of committee on the bills heard, crossover date. These journals will be posted at the Council office or the Legislative Auditor's office. B. A status report on bills may be provided as appropriate. C. When action on a bill requires immediate attention and procedural flexibility, the Inter-Governmental Relations Committee Chairperson or the Council Chairman will make a decision with a follow-up memorandum to Councilmembers, if necessary. D. Final wrap-up and evaluation will be submitted by the Inter-Governmental Relations Committee following the close of session. The report should include but not be limited to the following: (a) Recommendations for Council follow-up regarding possible gubernatorial veto actions. (b) Communications to the Governor regarding requests for the release of funds appropriated to the County.
