HomeMy WebLinkAboutRES 022 Draft 01 1988-1992OFFICE INFORMATION ONLY Meeting: February 15, 1989 Action: Adopt Res. 22-89 Re: Res. 22/IGRC-7 COUNTY OF HAWq~„v j;r,.~STATE OF HAWAII RESOLUTION No. ~ 83 WHEREAS, the practice of cosmetology is currently regulated by the State pursuant to Chapter 439, Hawaii Revised Statutes relating to Beauty Culture; and WHEREAS, the purpose of Chapter 439, Hawaii Revised Statutes is to protect the general public in its dealing with hairdressers, cosmeticians and cosmetologists by requiring that these professions be subject to formal education and practical requirements and be appropriately licensed; and WHEREAS, under Chapter 26-H, Hawaii Revised Statutes, relating to the Hawaii Regulatory Licensing Reform Act, licensing boards and commissions are terminated at specified times unless they are reestablished by the Legislature; and WHEREAS, Chapter 26-H, Hawaii Revised Statutes, provides that the provisions of Chapter 439 be sunset on December 31, 1989; and WHEREAS, the sunset of Chapter 439 would repeal the beauty culture licensing requirement and minimum standards of competency for practicing cosmetologists; and WHEREAS, the repeal of the above provisions may adversely affect beauty culture professionals' ability to obtain malpractice insurance and expose the public to incompetent or fraudulent practitioners. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it requests the Fifteenth Legislature of the State of Hawaii, Regular Session of 1989 to amend Chapter 26-H, Hawaii Revised Statutes to exclude Chapter 439, relating to Beauty Culture, from sunset provisions. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies of this resolution to the Honorable John Waihee, Governor, State of Hawaii; the Honorable Richard Wong, President of the Senate; the Honorable Daniel Kihano, Speaker of the House; the Honorable Steve Cobb, Chairman, Senate Committee on Consumer Protection and Commerce; the Honorable Mazie Hirono, Chairman, House Committee on Consumer Protection and Commerce; and Mr. Darrell Green, President, Hawaii State Hairdressers and Cosmetologists Association, Inc.
