HomeMy WebLinkAboutRES 024 Draft 01 1988-1992v COUNTY OF HAW:A~, °,:;:STATE OF HAWAII RESOLUTION No. 24 B9 WHEREAS, Chapter 2, Article 19, Hawaii County Code 1983, provides for the disposition of real property by a resolution duly approved by a majority of the members of the County Council; and WHEREAS, the State of Hawaii Department of Transportation, Highways Division, has scheduled the construction of the Keaau- Pahoa Road, FASP No. RS-0130(18), in the vicinity of Kahakai Boulevard to Kapoho and Kalapana Road Junction; and WHEREAS, Section 2-120, Hawaii County Code 1983, provides that the Council may direct the finance director to negotiate the disposition of real property to other governmental agencies, and WHEREAS, the State of Hawaii has requested the transfer of Parcel 21, TMK: 1-5-06, Portion of Puna Road, 10,065 Square Feet or .231 Acre, and Parcel 22, Portion of Pahoa-Kapoho Road between TMK: 1-5-03 and 1-5-06 (Portion of 6.6 mile State owned segment transferred to County of Hawaii under Phase I of the State Highway System Agreement dated January 30, 1968), 8,354 Square Feet or .192 Acre owned by the County of Hawaii; and WHEREAS, Section 264-2 of the Hawaii Revised Statutes provides for the transfer of County roads to the State when required for highway purposes. NOW, THEREFORE, BE IT RESOLVED by the Council of the County of Hawaii that it finds: 1) The County of Hawaii owns Parcels 21 and 22 identified by TMK: 1-5-06 Portion of Puna Road and TMK: 1-5-03; 2) The State of Hawaii Department of Transportation, Highways Division, desires to construct highway improvements on the property; and BE IT FURTHER RESOLVED that the foregoing findings of the Council are substantial reasons to allow the disposition of the certain parcels as determined in Section 2-120 of the Hawaii County Code and Section 264-2 of the Hawaii Revised Statutes; and BE IT FURTHER RESOLVED that the Director of Finance be directed to negotiate the disposition of the above identified parcels in accordance with this resolution; and BE IT FURTHER RESOLVED that the Director of Finance shall notify the State of Hawaii Department of Transportation, Highways Division, of the approval of this resolution. In connection with the proposed construction, they have asked that certain portions of land situated along the Pahoa-Kalapana and Pahoa-Kapcho Roads be transferred from County ownership to that of the State.
