HomeMy WebLinkAboutRES 036 Draft 01 1988-1992COUNTY OF HAWA e..;STATE OF HAWAII RESOLUTION No. 36 89 WHEREAS, the construction and development of the Queen Kaahumanu Highway has created a parcel out of that portion of Holualoa Road, consisting of 18,275 square feet and situated at Waiaha 1st and 2nd, North Kona, island of Hawaii, which is more particularly described in Exhibit "A," attached hereto; and WHEREAS, the parcel is a public roadway of which the County of Hawaii may have some legal title therein; and WHEREAS, due to its location and shape, said parcel is economically and physically unsuitable for development or utilization and is of no practical use to the County; and WHEREAS, section 2-118 of the Hawaii County Code, as amended, provides that any remnant or portion thereof to be disposed of shall be first offered for sale to the abutting owner for a reasonable period of time at a reasonable price based on appraisal value; and WHEREAS, the parcel has been appraised at FIVE THOUSAND AND NO/100 DOLLARS ($5,000.00) by Peter T. Young, an independent appraiser; and WHEREAS, Joseph Gomes and Margaret P. Gomes, husband and wife, are the owners of the land abutting said parcel; and WHEREAS, Mr. and Mrs. Gomes are ready, willing, and able to purchase any and all interest the County may have in said remnant parcel at its entire appraised value, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the parcel hereinabove described be declared a remnant. BE IT FURTHER RESOLVED that it authorize the sale of the remnant parcel by way of quitclaim deed to Joseph Gomes and Margaret P. Gomes for the price of FIVE THOUSAND AND NO/100 DOLLARS ($5,000.00). BE IT FURTHER RESOLVED that the director of finance of the County of Hawaii is hereby authorized to transact the sale of the remnant parcel to Mr. and Mrs. Gomes. Dated at Kona, Hawaii, this 5th day of April 1989. COUNTY CLERK cc: Corporation Counsel Finance Director Joseph and Margaret Gomes REPORT OF THE COMMITTEE ON PUBLIC WORKS DATE: March 21, 1989 PLACE: Councilroom TIME: 9:00 a.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Public Works to which was referred Resolution No. 36-89, reports as follows: The purpose of this resolution is to declare a portion of *_he Kailua-Holualoa Road, Waiaha 1st and 2nd, N. Kona, as a road remnant and to authorize the Director of Finance to sell this remnant. Pursuant to Section 2-118 of the Hawaii County Code, 1983, any remnant to be disposed of shall be offered for sale to the abutting property owners, Joseph and Margaret Gomes, based on the appraised value of Five Thousand Dollars, as determined by Peter Young, Independent Appraiser.
