RESOLUTION No.
41 89
WHEREAS, Section 220 of the Hawaiian Homes Commission Act of
1920, as amended, provides that the roads through or over Hawaiian
home lands, other than federal-aid highways and roads, shall be
maintained by the county in which said particular roads to be
maintained are located; and
WHEREAS, the Department of Hawaiian Home Lands, State of
Hawaii, has constructed roadway improvements upon that parcel of
land designated as Roadway Lot A, more particularly described in
Exhibit A, and shown in Exhibit B, both of which are attached
hereto and incorporated by reference herein; and
WHEREAS, the subject roadway lot is located within the
Panaewa Residence Lots, Unit III, Phase I, Panaewa, South Hilo,
Hawaii, TMK: 2-2-47:1(portion); and
WHEREAS, the improvements to the subject roadway have been
completed according to County dedicable standards and have been
given final approval by the Department of Public Works; and
WHEREAS, the Hawaiian Homes Commission has requested that the
County Council adopt a resolution acknowledging that the County
shall maintain said Roadway Lot A; and
WHEREAS, the subject roadway lot is not a federal-aid highway
or road.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that the County of Hawaii shall, pursuant to
legislative mandate, maintain the roadway improvements on those
certain streets within Unit III of the Panaewa Residence Lots,
more generally designated as Roadway Lot A.
