WHEREAS, the Fifteenth State Legislature of the State of
Hawaii, in the passage of Act 314, Session Laws of Hawaii 1989, at
Item 49, did appropriate and authorize the sum of $150,000 in Capital
Improvements Project (CIP) funds to be expended by the County of
Hawaii for the Ululani Street Improvements;
WHEREAS, the Ululani Street Improvements, Capital Project
No. J0302B, include the design and construction of a dedicable
roadway and necessary off-site improvements within that certain
unimproved segment of Ululani Street, Situate in Waiakea, District of
South Hilo, which project site is further shown on the location map
attached hereto as Exhibit "A" and made a part hereof;
WHEREAS, Capital Project No. J0302B will provide for the
construction of County dedicable roadway and utility improvements
over Ululani Street, presently a substandard roadway, beginning at
Lanikaula Street and running toward Olona Street to the extent
possible by said funding;
WHEREAS, it is anticipated that Capital Project No. J0302B will
be sufficient to fund the first phase of such improvements over a
portion (284 feet out of 611 feet) of Ululani Street, with further
improvements over the remaining road reserve to be constructed in two
subsequent phases contingent on further appropriations of CIP funds
by the State Legislature;
WHEREAS, said improvements will be constructed in conjunction
with a low-income multi-family housing project being developed by
Hilo Hale Ohana Associates on parcels adjoining said unimproved
segment of Ululani Street;
WHEREAS, said project will facilitate the development of
96 multi-family units of low-income housing in the County of Hawaii,
as well as provide much-needed roadway and off-site utility
improvements to other parcels adjoining this section of Ululani
Street, which is presently owned by the State of Hawaii;
WHEREAS, the request for release of said capital improvement
project funds to the County of Hawaii requires the consent and
approval of the Council, as set forth in Governor Waihee's Memorandum
No. 88-16, dated July 1, 1988, para. IV, C;
WHEREAS, the Council finds that the release of said funds is
necessary for the design and construction of certain roadway and
utility improvements to county-dedicable standards over Ululani
Street to the extent possible by increments;
WHEREAS, the Council further finds that the construction of
roadway and off-site improvements would facilitate, encourage,
expedite and promote the provision of low-income residential housing
by private developers to the residents of this County.
NOW, THEREFORE, BE IT RESOLVED BY 'PHE COUNCIL OF THE COUNTY OF
HAWAII that the Council approves and concurs with a request by the
Mayor of the County of Hawaii to the Governor of the State of Hawaii
for the release of $150,000, which amount represents the sum of
$20,000 for engineering costs and $130,000 for construction costs,in
Capital Improvement Project funds authorized by Act 314, Item 49,
Session Laws of Hawaii 1989, for the Ululani Street Improvements.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
transmit copies of this resolution to the Honorable John Waihee,
Governor of the State of Hawaii; to all Big Island legislators; and
the Honorable Bernard Akana, Mayor of the County of Hawaii.
