RESOLUTION No. 92 89 WHEREAS, the Fifteenth Legislature of the State of Hawaii, in the passage of Act 314, Session Laws of Hawaii 1989, Program No. SUB301, Capital Project No. HP0502, Item No. 43, did appropriate and authorize the sum of $40,000 in Capital Improvement Project (CIP) funds to be expended by the County of Hawaii for Kona Sidewalk Improvements; and WHEREAS,- the Kona Sidewalk Improvements project includes reconstruction of the existing cobblestone sidewalk along the makai-side of Alii Drive fronting the Kona Inn Shopping Center (TMK: 7-5-07:21) in Kailua Village, situated in the Kailua Village area, District of North Kona, Hawaii; and WHEREAS, the Kona Sidewalk Improvements project provides for removal of the cobblestone pavement and replacement with standard concrete pavement with a smooth traversable surface; and WHEREAS, the existing bumpy cobblestone sidewalk is uncomfortable and inconvenient to elderly and handicapped persons using the sidewalk in this area of Kailua Village; and WHEREAS, the request for release of said capital improvement project funds to the County of Hawaii requires the consent and approval of the Council of the County of Hawaii, as set forth in Governor waihee's Memorandum No. 88-16, dated July 1, 1988, para. IV, C; and WHEREAS, the Council finds that the release of said funds is necessary for construction of the Kona Sidewalk Improvements project to rectify the limited access which the present cobblestone sidewalk poses for the elderly and handicapped persons; and WHEREAS, this project will give all the persons free and unfettered access to the public sidewalk fronting the Kona Inn Shopping Center which is a major attraction area to both visitor and citizen alike. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Council approves and concurs with a request by the Mayor of the County of Hawaii to the Governor of the State of Hawaii for the release of $40,000 which amount represents the sum of $40,000 for construction costs, in Capital Improvement Project funds authorized by Act 314, Session Laws of Hawaii 1989, Program No. SUB301, Capital Project No. HP0502, Item No. 43, for the Kona Sidewalk Improvements project, Kona, Hawaii. BE I'P FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies of this resolution to the Honorable John Waihee, Governor of the State of Hawaii; to all Big Island legislators; and the Honorable Bernard Akana, Mayor of the County of Hawaii. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Inter-Governmental Relations, to which was referred Resolution No. 92-89, reports as follows: The purpose of this resolution is to request the release of $40,000 in capital improvement project monies appropriated by the Fifteenth Legislature for the Rona Sidewalk Improvement project. The Chief Engineer in Communication 607 addressed to your Committee stated he anticipated making a request for the release of monies, appropriated by the Fifteenth Legislature, for the Kona Sidewalk Improvement project which included removal of the cobblestone pavement and replacement with standard concrete pavement with a smooth traversable surface. He requested a. resolution in support of this project. .This resolution is offered pursuant to the Chief Engineer's request and to Governor John Waihee's Memorandum No. 8-16, paragraph IV, C, dated July 1, 1988 which requires the Council's consent before a request may be made by the expending agency for release of funds. This resolution asks for the release of $40,000 which amount represents the sum of $40,000 for construction costs in Capital Improvement Project funds authorized by Act 314, Program No SUB301, Capital Project No. HP0502, Item No. 43, Session Laws of Hawaii 1989.
