RESOLUTION No. 93 89 (DRAFT 2) WHEREAS, the Fifteenth Legislature of the State of Hawaii, in the passage of Act 314, Session Laws of Hawaii 1989, Program No. SUB301, Capital Project No. HP0303, Item No. 41, did appropriate and authorize the sum of $65,000 in Capital Improvement Project (CIP) funds to be expended by the County of Hawaii for plans and construction for downtown Hilo pedestrian improvements and for the rehabilitation of Kalakaua Park; and WHEREAS, the downtown Hilo pedestrian improvements and the rehabilitation of Kalakaua Park, Program No. SUB301, Capital Project No. HP0303, Item No. 41, situated in downtown Hilo, District of South Hilo, which project site is further shown on the location map attached hereto as Exhibit "A" and made a part hereof; and WHEREAS, the downtown Hilo pedestrian improvements consist of the acquisition of trash containers, decorative planters, and pedestrian furniture, sidewalk and gutter replacement, and the construction of an information kiosk; and WHEREAS, the rehabilitation of Kalakaua Park involves the replacement of the metal support structure and roof and repair of the plaster columns of the covered walkway, the restoration of cut stone walkways and walls and the acquisition of park furniture; and WHEREAS, the Council finds that these improvements further the goal of developing an economically revitalized downtown Hilo which is a safe, healthy, convenient, pleasant, and attractive environment for living, shopping, recreation, civic, cultural, and service activities, as directed by the Downtown Hilo Redevelopment Plan (DHRP); and WHEREAS, Hawaii Revised Statutes, §53-22(c), requires the County to match funds appropriated by the State Legislature for any redevelopment project or for assistance to a local redevelopment agency; and WHEREAS, $65,000 in Community Development Block Grant (CDBG) funds is available from the Department of Housing and Urban Development (HUD);and WHEREAS, if said CDBG funding is not utilized by the County in a timely manner, said CDBG funding will lapse; and WHEREAS, the Hawaii County Council in 1985 pursuant to Ordinance No. 85 67 appropriated $275,000 to the Downtown Hilo Revitalization Project, account no. 010-931-5932 from the Federal Grants Block Grant 1985, account no. 3301.89; and WHEREAS, the Hawaii County Housing Agency at its meeting of August 29, 1989 by motion duly made and carried approved the redirection of $158,000 from the Downtown Hilo Revitalization Project, Demonstration Loan Program account to match the State appropriation of $65,000; and WHEREAS, the Council finds that the release of said CDBG funds is necessary for the planning and construction of the downtown Hilo pedestrian improvements and the rehabilitation of Kalakaua Park; and NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the Council approves and concurs with the request by the Mayor of the County of Hawaii to the Governor of the State of Hawaii for the release of $65,000 which amount represents the sum of $2,000 for plans and $63,000 for construction costs in CIP funds authorized by Act 314, Program No. SUB301, Capital Project No. HP0303, Item No. 41, Session Laws of Hawaii 1989, for the rehabilitation of Kalakaua Park and downtown Hilo pedestrian improvements. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies of this resolution to the Honorable John Waihee, Governor of the State of Hawaii; to all Big Island legislators; and the Honorable Bernard K. Akana, Mayor of the County of Hawaii.
