RESOLUTION Na.

WHEREAS, Article V, Section 5-1.4(c) states that the Mayor has the
power to "Create positions...for which appropriations have been made by
the council...", and
WHEREAS, there has been a tremendous increase in the number of case
referrals to the Office of the Prosecuting Attorney, creating a backlog
in case reviews; and
WHEREAS, a screening unit would review and accept for prosecution
only those cases that meet office standards for completeness, legal
sufficiency, investigative adequacy and prosecutorial merit; and
WHEREAS, the education of the police on prosecution standards for
acceptance of police referrals would greatly expedite disposition of
cases; and
WHEREAS, a Deputy Prosecuting Attorney and a Senior Clerk
Stenographer would make up this screening unit; and
WHEREAS, the First Deputy Prosecuting Attorney is responsible for
the supervision of the legal, clerical, investigative, fiscal and
Victim/Witness sections of the Prosecutor's Office; and
WHEREAS, the First Deputy Prosecuting Attorney is also directly
involved in the planning, budgeting, implementation and review of the
Prosecutor's computer system as well as being involved in staff
hirings, personnel decisions, space allocation and site planning,
review of case disposition, case analysis, personnel recruitment and
interviews; and
WHEREAS, the clerical work for
the Prosecutor's private secretary

the First Deputy is usually done by
or a legal stenographer assigned to
WHEREAS, a Senior Clerk-Stenographer assigned to the First Deputy
would expedite the paper flow of the Prosecutor's Office;
WHEREAS, funds are available in the Contingency Account of the
General Fund,
NOW, THEREFORE, BE IT RESCLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that one (1) Deputy Prosecuting Attorney position and two (2)
Senior Clerk-Stenographer positions be created.
BE IT FURTHER RESOLVED that additional funds are needed to fund
these three (3) positions as follows:
Deputy Prosecuting Attorney
Senior Clerk-Stenographer
Senior Clerk-Stenographer

BE IT FURTHER RESOLVED that 31,820 be transferred from the
Contingency Account of the General Fund to the Regular Salaries and
Wages account of the Office of the Prosecuting Attorney.
BE IT FURTHER RESOLVED that a copy of this resolution be
transmitted to the Departments of the Prosecuting Attorney, Civil
Service and Finance.
