RESOLUTION No. 1~ 90
WHEREAS, Keauhou Kona Resort Company is the developer of that
certain subdivision known as Keauhou Estates, situated at Kahaluu
and Keauhou, North Kona, Island of Hawaii; and
WHEREAS, in 1987, the developer intended to dedicate to the
County Roads A and B, located within the subdivision, and more
particularly described in Exhibit "A," attached hereto; and
WHEREAS, in furtherance of that intent, the developer
consequently executed a dedication deed in favor of the County and
inadvertently recorded the same with the Bureau of Conveyances on
September 29, 1987; and
WHEREAS, such recordation was done before the subject roadway
parcels were formally accepted by the Hawaii County Council, as
required by Hawaii County Charter Section 13-12; and
WHEREAS, subsequent to such recordation, the developer decided
to retain private ownership in the subject roadway parcels rather
than to dedicate those parcels to the County; and
WHEREAS, inasmuch as the Bureau of Conveyances has no mechanism
available to it with which to negate the improper recordation of the
subject deed, the developer has requested that the County execute a
quitclaim deed in favor of it in order to clear the title on the
above roadway parcels; and
WHEREAS, pursuant to Hawaii County Code Section 2-111, any such
grant of interest in real property owned by the County must be
authorized by the County Council,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the Mayor of the County of Hawaii is hereby authorized
to execute a quitclaim deed in favor of the developer for the
roadway parcels hereinabove described.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
is hereby directed to transmit copies of this Resolution to the
Mayor of the County of Hawaii, Kamehameha Investment Corporation,
and Keauhou Kona Resort Company.
