HomeMy WebLinkAboutRES 133 Draft 01 1988-1992COUNTY OF HAW`A~ ~;;,~STATE OF HAWAII RESOLUTION No. 133 90 RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT TO SATISFY THE AFFORDABLE HOUSING REQUIRE~dENT FOR THE SOUTH KOHALA RESORT WHEREAS, on May 6, 1985, the State land Use Commission (SLUG) approved the reclassification of 399 acres of land from an Agricultural to an Urban district for property situated at Ouli 1, District of South Kohala, Hawaii; and WHEREAS, the SLUG reclassification included a condition relating to the provision of housing opportunities for low and moderate income Hawaii County residents and employees; and WHEREAS, on January 7, 1986, the Hawaii County Planning Commission approved Special Management Area Use Permits (SMA $5-16 and SMA 85-17); and WHEREAS, on June 2, 1986, by action of the Hawaii County Council, Change of Zone Ordinance No. 86-45 became effective and rezoned parts of these lands to allow development of the South Kohala Resort; and WHEREAS, SMA Permits 85-16 and 85-17 and Change of Zone Ordinance 86-45 included affordable housing conditions consistent with the SLUG condition previously approved; and WHEREAS, the affordable housing condition of SMA Permits 85-16 and 85-17 and Change of Zone Ordinance No. 86-45 stipulate that the manner in which the required affordable employee housing units or other related mitigation measures are to be provided shall meet with the approval of the Planning Director and the concurrence of the Hawaii County Housing Agency prior to commencing construction of the hotel and further that the requirements of this condition shall be complied with prior to the hotel commencing operation; and WHEREAS, discussions with MKP have culminated with the agreement that MKP will make payment of TWO MILLION FORTY-THREE THOUSAND SIX HUNDRED TWELVE AND NO/100 DOLLARS (52,043,612.00) to the County in satisfaction of the affordable and/or employee housing requirements fora 350 unit hotel and 550 residential units at the South Kohala Resort; and WHEREAS, MKP has agreed to make one full payment within thirty (30) days of the execution of this agreement and will be given credit for two hundred and two (202) affordable housing units represented by the payment of the aforesaid in lieu amount; and WHEREAS, the Planning Director has reviewed the proposed manner in which the required affordable employee housing units or other related mitigation measures are to be provided and has given his approval. NOW, THEREFORE, BE IT RESOLVED BY THE HA~dAII COUNTY HOUSING AGENCY that the Chairman of the Hawaii County Housing Agency and the Mayor of the County of Hawaii are hereby authorized to execute an agreement with Mauna Kea Properties to satisfy the affordable housing requirement in accordance with SMA Permits 85-16 and 85-17 and Change of Zone Ordinance No. 86-45. Resolution authorizing the execution of an agreement to satisfy the affordable housing requirement for the South Kohala Resort. 2. Resolution authorizing the execution of an agreement to satisfy a portion of the affordable housing requirement for the Kaupulehu Developments. The HCHA has reviewed and approved the Resolutions at its meeting of December 20, 1989. Accordingly, I am requesting that the Resolutions be included on the Council agenda for action at its January 16, 1990 meeting. HSR/dmv Attach. xc: A.
