HomeMy WebLinkAboutRES 134 Draft 01 1988-1992COUNTY OF HAVIf, ~ >;, STATE OF HAWAII ~:,;_ RESOLUTION No. 234 90 RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT TO PARTIALLY SATISFY THE AFFORDABLE HOUSING REQUIREMENT FOR THE KAUPULEHU DEVELOPMENTS WHEREAS, on October 24, 1986, the State land Use Commission (SLUG) approved the reclassification of 575 acres of land from an Agricultural to an Urban district for property situated at Kaupulehu, District of North Kona, Hawaii; and WHEREAS, the SLUG reclassification included a condition relating to the provision of housing opportunities for low and moderate income Hawaii County residents and employees; and WHEREAS, on October 27, 1988, by action of the Hawaii County Council, Change of Zone Ordinance No. 88-157 became effective and rezoned the property to allow resort, multi-family residential, commercial and open uses; and WHEREAS, Change of Zone Ordinance No. 88-157 included an affordable housing requirement which was assessed on both the resort and residential components of the proposed project; and WHEREAS, the affordable housing condition of Change of Zone Ordinance No. 88-157 stipulates that the affordable housing requirement shall be implemented concurrently with the completion of units for the resort/residential project and, further, that the method of satisfying the affordable housing requirement must be approved by the Hawaii County Housing Agency, after review and recommendation by the Office of Housing and Community Development, and prior to the issuance of Final Plan Approval for any phase or increment of the proposed resort/residential development; and WHEREAS, Kaupulehu has submitted plans for Plan Approval for the 358-unit Four Seasons Hotel and is ready to proceed with its development; and WHEREAS, Kaupulehu has elected to provide units as the method of satisfying the affordable housing condition; and WHEREAS, Kaupulehu has agreed to use good faith efforts working with the County to explore opportunities to plan, design, finance, construct, market, or acquire real property for the development of affordable housing units and related improvements; and WHEREAS, Kaupulehu has agreed to inform the County, no later than six (6) months after the commencement of construction of the Four Seasons Hotel, if it cannot perform the aforesaid obligations and elects to make a monetary payment in lieu of performing the aforesaid obligations; and WHEREAS, the County Housing Agency may re view.the in lieu payment request, the approval of which shall not be unreasonably withheld; and WHEREAS, the total amount of such payment shall be calculated pursuant to Condition K of Ordinance No. 88-157 and based on the number of resort units allowed by the Final Plan Approval issued for the Four Seasons Hotel; and WHEREAS, Kaupulehu has agreed to pay the County within thirty (30) days of the County Housing Agency's approval of the in lieu payment alternative; and WHEREAS, the Office of Housing and Community Development has reviewed the proposed method of satisfying the affordable requirement for the Four Seasons Hotel and is recommending its approval. NOW, THEREFORE, BE IT RESOLVED BY THE HAWAII COUNTY HOUSING AGENCY that the Chairman of the Hawaii County Housing Agency and the Mayor of the County of Hawaii is hereby authorized to execute an agreement with Kaupulehu Developments to satisfy the affordable housing requirement for the Four Seasons Hotel increment in accordance with Change of Zone Ordinance No. 88-157.
