RESOLUTION No. 154 90
WHEREAS, Section 10-11 of the County Charter requires that any
contract, lease or other obligation requiring payment of funds from
appropriations of a later fiscal year or of more than one fiscal year be
approved by resolution of the Council; and
WHEREAS, the County wishes to enter into a multi-year contract to
enter into a lease with purchase options for eighty-four (84) months
starting from July 1, 1990, and ending June 30, 1997, for a Crawler
tractor with bulldozer - CAT D8N; and
WHEREAS, the County of Hawaii operates sanitary landfills in
accordance with applicable requirements; and
WHEREAS, the County of Hawaii entered into a lease-purchase
agreement with Pacific Machinery, Division of Theo. H. Davies & Co.,
Ltd., to acquire a Caterpillar 826C Landfill Compactor under Bid Proposal
No. 1150 on March 21, 1988; and
WHEREAS, the Caterpillar 826C Landfill Compactor has not performed
effectively; and
WHEREAS, the County of Kauai must purchase a Landfill Compactor to
meet its landfilling requirements; and
WHEREAS, the County of Kauai has offered to purchase the Caterpillar
826C Landfill Compactor; and
WHEREAS, the Caterpillar D8N Bulldozer acquired under the same Bid
Proposal No. 1150 performs effectively and is more reliable; and
WHEREAS, the County of Hawaii has an ideal opportunity to replace
the Landfill Compactor with a DSN Bulldozer; and
WHEREAS, the acquisition of another D8N Bulldozer under a
lease-purchase would further improve landfill operations; and
WHEREAS, the Standardization Committee of the County of Hawaii has
reviewed and approved the renegotiated lease-purchase agreement of a
Caterpillar D8N Bulldozer; and
WHEREAS, the Standardization Committee has determined that a
renegotiated lease-purchase agreement is in the best interest of the
County of Hawaii.
NOW, THEREFORE, BE IT RESOLVED that the Council of the County of
Hawaii, does hereby authorize the Mayor of the County of Hawaii to enter
into a renegotiated lease agreement with purchase option with Pacific
Machinery, Division of Theo. H. Davies & Co., Ltd., to be effective
July 1, 1990.
