RELATING TO THE CONSTRUCTION OF IMPROVEMENTS IN THE KALOKO SUBDIVISION,
KALOKO, DISTRICT OF NORTH KONA, HAWAII.
WHEREAS, by Petition filed December 19, 1986, TSA International, Ltd.
("Petitioner"), who is owner of certain real property located at
Kaloko, District of North Kona, County and State of Hawaii, petitioned
this Council for improvements consisting of a roadway, drainage
system, water system and electrical and street lighting systems on the
real property, the cost of which is to be borne by the property owner
pursuant to the provisions of Section 12-16, Hawaii County Code, as
amended; and
WHEREAS, in the Petition, Petitioner alleges that it is the owner
of one hundred percent (1008) of the entire assessable area within the
proposed improvement district; and
WHEREAS, the Petition refers to the necessary preliminary scope of
work, maps and other data, details and preliminary specifications for
the proposed improvements, together with estimates of the probable
cost thereof, and shows a description and an estimate of the share of
the cost of the improvements against each parcel of the real property
subject to assessment; and
WHEREAS, the Petition has now been further and fully considered by
the Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that (1) the Chief Engineer of the County of Hawaii be and is
hereby directed to investigate the information and data provided by
the Petitioner and such other information as the Chief Engineer deems
advisable and to report to the Council on the necessity, feasibility
and method of assessment desirable for the aforementioned roadway,
drainage, water, electrical and street light improvements at Kaloko,
District of North Kona, County and State of Hawaii; and to include in
his preliminary report all such data, survey, maps, plans, drawings,
details, specifications for the improvements and any other matters or
details intended to apply thereto in accordance with the provisions of
Section 12-10, Hawaii County Code, as amended; (2) the Chief Engineer
shall request and obtain from the Department of Water Supply and
incorporate into his report, preliminary plans and estimates of the
proposed water system to be constructed as a part to the proposed
improvement district; and (3) the Chief Engineer shall, upon
notification by the Council, consult with such financial consultant
and bond counsel as the Council may hereafter employ with respect to
the proposed improvement district and incorporate into any subsequent
report the comments or recommendations of such persons.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
transmit copies of this resolution to the Petitioner and the Chief
Engineer.

Your Committee on Public Works to which was referred Resolution
No. 158-90, reports as follows:
TSA International, Ltd. is the owner of certain real property located
in the Kaloko Subdivision, Kaloko, District of North Kona, Hawaii.
TSA has submitted a petition to the Council for improvement to
include a roadway, drainage and water systems, and electrical and
street lighting, for their property in the Kaloko Subdivision for
which they will bear the cost.
Resolution No. 158-90 directs the Chief Engineer of the County of
Hawaii to investigate and review the information provided by the
Petitioner and any other information that he may deem advisable. The
Chief Engineer shall submit a report to the Council as to the
necessity, feasibility and method of assessment desirable for the
improvements and include in his report all data, survey, maps, plans,
drawings and detail specifications. The Chief Engineer shall also
obtain preliminary plans for the water system from the Department of
Water Supply and consult with a financial consultant and bond counsel.
Your Committee questioned the cost and the location of the water
system for this project. The petitioner indicated that part of the
system would be along the roadway and other parts, such as the
storage tanks would be away from the roadway. The petitioner did not
have available, at the meeting, the exact cost of the water system,
but estimated it at about $5.4 million. He also added that the
Department of Water Supply would be covering one third of the cost.
In response to the Committee's concern for a sewage systems, the
petitioner reported that a sewage system was not in the scope of this
petition for improvements and is too premature to discuss. However,
depending on the type of system needed, the developer might return to
the Council for a separate petition for an improvement district for
the sewer.
Your Committee also requested that the resolution be amended to
include the name of the-petitioner, TSA International Ltd., for
identification purposes.
