RESOLUTION No. 16~ 90 (DRAFT 2) RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE HAWAII HOUSING AUTHORITY FOR THE EMERGENCY SHELTER GRANT PROGRAM FUNDS WHEREAS, the U.S. Department of Housing and Urban Development (HUD) has invited the State to submit a $58,000 application for the 1990 Emergency Shelter Grants Program (ESGP) funds; and WHEREAS, the State has designated the Hawaii Housing Authority (HHA) as the agency to administer the ESGP; and WHEREAS, the HHA submitted an application to HUD for the $58,000 ESGP funds; and WHEREAS, the HHA is making $58,000 of ESGP funds available to the neighbor island counties (Hawaii, Maui, and Kauai); and WHEREAS, the Office of Housing and Community Development (OHCD), County of Hawaii, developed a Homeless Assistance Plan based on strong statements of need from local social welfare agencies that deal with the problem of homeless individuals and families on a daily basis in the County of Hawaii; and WHEREAS, an executed Memorandum of Understanding between the County of Hawaii and the HHA will provide the legal mechanism by which the HHA can obligate the ESGP funds to the County of Hawaii; and WHEREAS, the County of Hawaii has participated in the ESGP since 1987 and wishes to continue its participation in the ESGP. NOW, THEREFORE, BE IT RESOLVED BY THE HAWAII COUNTY COUNCIL, that the Mayor or his designated representative is hereby authorized to enter into a Memorandum of Understanding with the Hawaii Housing Authority for the 1990 Emergency Shelter Grant Program funds. BE IT FURTHER RESOLVED that the Hawaii County Housing Agency is hereby authorized to approve, with the recommendation from the Office of Housing and Community Development, the selection of the 1990 ESGP project for the 1990 program. BE IT FURTHER RESOLVED that the County shall utilize the ESGP funds in accordance with the approved Homeless Assistance Plan, the Memorandum of Understanding, and, will comply with all pertinent U.S. Department of Housing and Urban Development rules and regulations governing the ESGP. BE IT FURTHER RESOLVED that the Mayor or his designated representative is authorized to take any actions necessary to create and administer the ESGP for the County of Hawaii. S. Department of Housing and Urban Development's (hereinafter called HUD) Emergency Shelter Grants Program (hereinafter called ESGP); and WHEREAS, the Hawaii County Council has adopted Resolution Number authorizing an agreement between the County and the HHA; and WHEREAS, the HHA approved, through HHA Commission's action, to participate with the County on this program; and WHEREAS, the COUNTY, in an effort to provide assistance to the HHA, requires the obligation of (E ) to the COUNTY; and WHEREAS, the HHA on obligate DOLLARS has authorized approval to DOLLARS (a ) to the COUNTY; NOW, THEREFORE, the COUNTY and the HHA, in consideration of the mutual promises hereinafter set forth, hereby agree as follows: 1. The HHA shall pay directly to the contracted non-profit organization for eligible expenses, the sum total of DOLLARS (E ). Upon receipt of the above documents, the HHA shall request the ESGP funds from the federal government and release the ESGP funds directly to the contracted non-profit organization; 2. The COUNTY shall implement its Emergency Shelter Grants Program in accordance with all pertinent HUD rules and regulations; and 4. A copy of the COUNTY'S Performance Reports(s) will be transmitted to the HHA. Population Profile The homeless in the County of Hawaii include individuals and entire households who come from all ages, ethnic and socio-economic groups. They include single and two parent families, children and youth, single adults, and the elderly. There are many factors which contribute to the state of homelessness such as mental illness, alcoholism, drug addiction, physical abuse or neglect, unemployment, poverty, etc., and a few who have chosen homelessness as a life style. There has been no formal survey undertaken to obtain an exact count of the County's homeless population, however, a 1983 survey conducted by the Health and Community Services Council of Hawaii estimated that there are 600 homeless persons in the County of Hawaii. Needs The following is a listing of shelters in the County of Hawaii: EMERGENCY SHELTERS 1. Cumulatively, they are able to serve approximately 76 persons. Comparing the availability of emergency shelters with the aforementioned estimates of the County's homeless population, there is an extreme shortage of emergency shelters relative to the number of persons in need of such assistance. County of Hawaii Homeless Assistance Plan Page 3 Strategy Emergency Shelter Grants Program (ESGP) funds are available to the County of Hawaii to meet the needs of the homeless population. Agencies awarded ESGP funds must provide matching funds of an equal amount. In order to maximize the effectiveness of these monies, the County's strategy for the use of program funds is to create new shelters and programs benefitting the homeless and to expand existing facilities and programs for the homeless. Program objectives related to this strategy include the following: 1. Create new emergency shelters for the homeless. 2. Expand existing facilities for the homeless. 3. Create new support programs for the homeless. 4. Expand support services that enable the homeless to achieve independent living. 5. Subsidize homeless shelter operators, so they are able to maintain their ability to provide emergency shelters. 6. Improve physical conditions at existing shelters. Implementation The County will make the ESGP funds available to providers of emergency shelter services on a competitive basis. Proposals for the use of funds will be solicited from public and private non-profit agencies. 1. Qualifications. In order to be eligible for program funds, applicants must, at a minimum: a. Be able to match the ESPG funds, and b. Bea public agency or private non-profit organization. 2. Activities to be funded. The following are the three major categories of activities expected to be undertaken: County of Hawaii Homeless Assistance Plan Page 4 a. Renovation, major rehabilitation or conversion of buildings for use as emergency shelters. The high cost of construction may limit the extent to which these activities can be funded through the County's program, nevertheless, up to 100% of the grant will be allowed for renovation, rehabilitation or conversion provided that a viable proposal is submitted by an applicant and accepted by the County. Special conditions apply to the use of ESGP funds for the renovation, rehabilitaion or conversion of buildings owned primarily by religious organizations and entities. b. Payment of major expenses including payments for maintenance, operations, rent, insurance, utilities and furnishings but excluding staff salaries. c. Provision of essential services including, but not limited to, services concerned with employment, health, substance abuse, education, or food which are intended to assist clients of emergency shelters to achieve independent living status. Essential services also include efforts to prevent homelessness such as financial assistance to families who have received eviction notices or notices of termination of utility services if: 1) the inability of the family to make the required payments is due to a sudden reduction in income; 2) the assistance is necessary to avoid the eviction or termination of services; 3) there is a reasonable prospect that the family will be able to resume payments within a reasonable period of time; and 4) the assistance will not supplant funding for preexisting homelessness prevention activities from other sources. Program regulations limit funding for essential services to no more than 20~ of the total grant. In addition, funds must be spent on the provision of new services or a measurable increase in existing services. 3. Priority. Priority will be given to applicants whose programs create new or expand emergency shelters to serve singles, families, or elderly. County of Hawaii Homeless Assistance Plan Page 5 4. Drug-free Policy. Project sponsors shall administer, in good faith, a policy designed to ensure that the homeless facility is free from the illegal use, possession, or distribution of drugs or alcohol by its beneficiaries. 5. Schedule. Upon notification of the availability of ESGP funds, the County will solicit proposals from applicants through public notice. Prospective applicants will be given 30 days to prepare and submit their proposals to the Office of Housing and Community Development (OHCD). The OHCD will then evaluate the proposals and recommend to the Hawaii County Housing Agency their selected project. Upon HCHA approval, the OHCD will award the ESGP funds to their selected project. The HCHA has reviewed and approved the resolution at its meeting of March 7, 1990. Accordingly, I am requesting that the resolution be included on the Council agenda for action at its next meeting.
