RESOLUTION No. 1~0 30
WHEREAS, the Hawaii Redevelopment Agency (HRA) and the Hilo
Downtown Improvement Association (HDIA) propose the placement of
58 new planters, 50 new trash receptacles, and 16 new benches in
downtown Hilo; and
WHEREAS, in accordance with section 22-58(c), Hawaii County
Code, any person desiring to place an object on a sidewalk
(including but not limited to a planter box, litter receptacle, or
bench) shall, upon recommendation of the chief engineer, obtain
approval of the Council by resolution of the Council; and
WHEREAS, the chief engineer of the County has recommended the
placement of these 58 new planters, 50 new trash receptacles, and
16 new benches in downtown Hilo; and
WHEREAS, the Hilo Downtown Improvement Association will be
responsible for the maintenance and care of the new planters; and
WHEREAS, the Department of Public Works will maintain and
collect the trash in the new trash receptacles in accordance with
its current downtown pick-up schedule; and
WHEREAS, the Department of Public Works will be responsible
for the maintenance of the new benches; and
WHEREAS, the Council finds that these improvements further
the goal of developing an economically revitalized downtown Hilo
which is a safe, healthy, convenient, pleasant, and attractive
environment for living, shopping, recreation, civic, cultural, and
service activities, as directed by the Downtown Hilo Redevelopment
Plan (DHRP).
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that the Council approves and concurs with the
recommendation of the chief engineer of the County to place 58 new
planters, 50 new trash receptacles, and 16 new benches in downtown
Hilo and that the Hilo Downtown Improvement Association shall be
responsible for the maintenance and care of the new planters, and
that the Department of Public Works shall be responsible for the
maintenance and collection of the trash deposited in the new trash
receptacles and for the maintenance of the new benches.
BE IT FURTHER RESOLVED that the County Clerk be and is hereby
instructed to transmit copies of this resolution to:
1. Hawaii Redevelopment Agency
2. Hilo Downtown Improvement Association; and
3. Chief Engineer, Department of Public Works.

Re: Waiver of Committee Referral
Pursuant to Section 1(d) of Rule 4 of the Rules of Procedure of the
Council of the County of Hawaii, this written approval is submitted
in regards to Communication No. 1546 and attached Resolution
No. 170-90, relating to planters, trash receptacles and pedestrian
furniture for Downtown Hilo, for waiving said referral from the
Committee on Public Works in order that appropriate action can be
taken by the Council.
In reviewing the contents of the referral, it is deemed advisable
that such waiver be granted and that Communication No. 1546 and
attached Resolution No. 170-90 be reported directly from the
Subcommittee on Beautification to the Council.
