RESOLUTION No. 188 90
WHEREAS, GTE Hawaiian Telephone Company Incorporated and
Hawaii Electric Light Company, Inc., are desirous of obtaining
easement rights over a parcel of land located along the northeast
corner of the Pahoa High and Elementary School site, such parcel
being more particularly described in Exhibit "A," attached hereto
and made a part hereof; and
WHEREAS, the easement is necessary for the appropriate
placement of an overhead poleline jointly owned by the two
companies; and
WHEREAS, although fee title to the property affected by the
proposed easement is vested in the County of Hawaii, the land is
presently under the control of the State for school purposes and
is expected to be turned over to them in the future; and
WHEREAS, the Hawaii District Department of Education has
indicated no objections to the granting of the easement and the
installation and maintenance of utility poles within the subject
area, as evidenced by Exhibit "B," attached hereto and made a part
hereof; and
WHEREAS, section 2-111 of the Hawaii County Code provides
that any grant of interest in real property owned by the County
must be authorized by the County Council,
NOW, THEREFORE, BE IT RESOLVED BY THE C~~UNCIL OF THE COUNTY
OF HAWAII, that the Mayor of the County of Hawaii is hereby
authorized to execute grants of easement in favor of GTE Hawaiian
Telephone Company Incorporated and Hawaii Electric Light Company,
Inc.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
is hereby directed to transmit copies of this Resolution to the
Mayor of the County of Hawaii, GTE Hawaiian Telephone Company
Incorporated, and Hawaii Electric Light Company, Inc.
