WHEREAS, the Hamakua Sugar Co., Inc., due to heavy losses in recent years secured in 1988 a $10 million, 5-year loan from the State of Hawaii at an interest rate of three (3) percent; and WHEREAS, in order to maintain the viability of its operations the Hamakua Sugar Co., Inc. is offering for sale various parcels of its landholdings totalling 5,098 acres on June 28 and August 16, 1990; and WHEREAS, the largest land parcel denominated "Waipio-Mauka" containing 2,640.553 acres is being offered for $30 million; and WHEREAS, the Waipio-Mauka parcel, a contiguous acreage borders the northern shoulder of Waipio Valley, provides a dramatic view of Waipio, Hiilawe waterfall and the ocean inlet; and WHEREAS, the second largest parcel denominated "Waipio-Makai", encompasses two disconnected parcels of land located at Kukuihaele containing 960.607 acres, is offered for sale at $17 million; and WHEREAS, Waipio-Makai situated close to the Flaipio Valley begins at bluffs overlooking the ocean and rises to an elevation of 800 feet with spectacular views of the ocean as well as ocean frontage; and WHEREAS, Article XI, Section 4, Constitution of the State of Hawaii, provides that the State has the power to acquire interests in real property to control future growth, development and land use within the State; and WHEREAS, Article XI, Section 3, Constitution of the State of Hawaii, mandates the State to conserve and protect agricultural lands, promote diversified agriculture, increase agriculture self-sufficiency and assure the availability of agriculturally suitable lands; and WHEREAS, there is great interest by many small farmers to undertake the development of small farms in this area if lands are made available by the State in the form of agriculture parks; and WHEREAS, this Council wishes to discourage prospective purchasers from formulating an expectation that the Council will assent to the use of the Waipio lands f.or development or any other uses except bona fide agricultural production; and WHEREAS, this Council believes that the historic nature and unique beauty of Waipio Valley requires that a portion of the Waipio-Mauka parcel which is located along and surrounding the south side of the rim of the Waipio bluff overlooking the valley should be preserved to enhance the vistas of Waipio Valley and for future use possibly as a park. NOW, THEREFORE, BE IT RESOLVED BY THE COCTNCIL OF THE COUNTY OF HAWAII that Governor John Waihee and Mr. William Paty, Director, Department of Land and Natural Resources are strongly urged to acquire the Alaipio-Mauka and the Waipio-Makai lands being offered for sale by the Hamakua Sugar Co., Inc. and that these lands be developed into agriculture parks for the purpose of diversified agriculture use. and WHEREAS, this Council strongly believes these lands are ideal for expansion of the State's agriculture parks development program for use in diversified agriculture; and WHEREAS, Article XI, Section 2, Constitution of the State of Hawaii, provides that the State and its political subdivisions shall conserve and protect Hawaii's natural beauty and all natural resources, including land and shall promote the development and utilization of these resources in a manner consistent with their conservation and in furtherance of the self-sufficiency of the State; and WHEREAS, the Council recognizes certain rural characteristics of small townships and communities must be maintained to preserve that certain quality of life to which the community has become accustomed and wants to retain; and WHEREAS, unless these communities are protected, pressure to urbanize will mount to alter the rural character of the community and the surrounding rural environment; and WHEREAS, the Council finds that the sale of large tracts of land to private owners will precipitate pressure to urbanize these and other existing agriculture lands; and WHEREAS, it is the duty of this Council to oversee and determine the use to which lands within the jurisdictional boundaries of the County of Hawaii are put; and WHEREAS, this Council encourages the preservation of agriculture lands for farming and the development of farm products and by-products; and WHEREAS, this Council will not look favorably upon a change that would intensify the land use of the Waipio-Mauka and Waipio-Makai lands; and WHEREAS, this Council wishes to apprise prospective purchasers of the Waipio-Mauka and Waipio-Makai lands of its pre-disposition regarding the use of these lands; and WHEREAS, this Council wishes to discourage prospective purchasers from formulating an expectation that the Council will assent to the use of the Waipio lands for development or any other uses except bona fide agricultural production;
