WHEREAS, pursuant to Section 13-12, County Charter, County of Hawaii,
Acceptance of Gifts or Donations, the Council may accept gifts of real estate
on behalf of the County; and
WHEREAS, on April 1, 1987, by Resolution No. 290-87, the Hawaii County
Council approved the Community Development Block Grant (hereinafter CDBG)
application to the U.S. Department of Housing and Urban Development (HUD); and
WHEREAS, the Hawaii County Housing Agency (hereinafter HCHA) has
approved the development of the Captain Cook Elderly Housing Project on
January 25, 1989; and
WHEREAS, on February 15, 1989, the HCHA approved CDBG funds for the
acquisition of land and the development of the Captain Cook Elderly Housing
Project, on said land; and
WHEREAS, the subject 2.509 acre site, identified as Lot 1,
T'4K: 8-2-O1;Por. 125, was appraised at 5770,000; and
WHEREAS, Kealakekua Ranch, Ltd., has agreed to sell the property to the
County for the sum of 5228,675,00; and
WHEREAS, Under Federal regulations that govern real property acquisition
utilizing United States Department of Urban Development's (HUD) Community
Development Block Grant (CDBG) funds, Kealakekua Ranch, Ltd., is entitled to
receive the determined just compensation for the subject property.
WHEREAS, Kealakekua Ranch, Ltd., has agreed to donate the balance of the
estimated appraised value of 5770,000.00, which is 5541,325.00 to the County
in order to assist the County in its efforts to provide affordable housing to
the elderly.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that the Council accept the donation of land from Kealakekua Ranch, Ltd., in
order to assist the County in its efforts to provide affordable housing to the
elderly.
BE IT FURTHER RESOLVED that a true and correct copy of this resolution
be transmitted to Kealakekua Ranch, Ltd., Kona Housing Corporation and the
Office of Housing and Community Development.
