RESOLUTION No. 20'7 30
WHF,REAS, on October 18, 1988, the County of Hawaii established
two agreements with Pacific waste Recovery Systems, Inc. and Waste
Recovery Systems, Kona, Inc.. for the removal and disposal of waste
metals from the County landfills ar.d other properties and also for a
landfill reclamation at the S+Iest Hawaii Sanitary Landfill; and
WHEREAS, the agreement for the landfill. reclamation requires
that the completion of a facility for the reclamation system shall
not exceed twenty months from the date of contract execution; and
WFIEREAS, June 18, 1990 marks the twentieth month after the
contract execution date and the construction of the facility for the
landfill reclamation system has yet to hegin; and
WHEREAS, to date, none of the scrap metal, under the waste metal
agreement, has peen removed from any of the County landfills or
other properties; and
WHEREAS, Pacific Glaste Recovery Systems, Inc. and Waste Recovery
Systems, Kona, Inc, have not shown any positive effort to comply
with the agreements, as evidenced by their failure to complete the
landfill reclamation system facility and their failure to remove any
waste metal from the landfills; and
WHF.RF,AS, the council feels that the lack of the performance of
Pacific Waste Recovery Systems, Inc. and Waste Recovery Systems,
Kona, Inc, to fulfill their part'of the agreements are hindering
their effort to incorporate an integrated waste management program
for the County of Hawaii.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it requests that the Chief Engineer and the Corporation
Counsel terminate the agreements with Pacific Waste Recovery
Systems, Inc. and Waste Recovery Systems, Kona, Inc. for the
landfill reclamation at the West Hawaii Sanitary Landfill, and the
waste metal removal at the County landfills and other properties,
due to the lack of their compliance with the requirements of the
agreements.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
transmit a copy of this resolution to Chief Engineer Bruce McClure,
Corporation Counsel Richard Miyamoto and to the representatives of
Pacific Waste Recovery Systems, Inc, and hiaste Recovery Systems,
Kona, Inc.
