221 90
WHERF,AS, Article XV, Hawaii County Charter, Relating to Charter
Amendment or Revision, provides for proposals to be enacted by
ordinance of the council adopted by the affirmative vote of
two-thirds of 'the entire membership on three readings; and
WHEREAS, upon adoption of an ordinance, the council shall by
resolution provide that the proposed amendment be submitted to the
electors of the county for approval at the next general election; and
WHEREAS, said resolution shall provide for the publication of
the full text of the proposed amendments in a daily newspaper of
general circulation in the county at least forty-five days prior to
the submission to the electorate; and
WHEREAS, at its July 19th meeting, the council adopted on third
reading by the affirmative vote of two-thirds of the entire
membership Bill 255; and
t~?HFRFAS, Rill 255, enacted as Ordinance No. 90-92, amends
Section 10-2(a), Article X, Hawaii County Charter, to provide for
r.he mayor to submit to the council on or before March 1 of each year
(1) an operating budget for the ensuing fiscal year; (2) an
operating program for the ensuing three fiscal years; (3) a capital
budget for the ensuing fiscal year; (4) a capital program for the
ensuing six fiscal years; and (5) an accompanying message.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that in conformance with Section 15-2, Hawaii County Charter,
the Clerk of the County of Hawaii is hereby instructed to make the
necessary arrangements to have the proposed charter amendment, as
incorporated in Ordinance No. 90-92, placed on the ballot at the
General Election of November. 6, ].990.
BE IT FURTHER RESOLVED that the Clerk is also instructed to have
the full text of the proposed amendment published in a daily
newspaper of general circulation in the county at least forty-five
days prior to the general election.
BE IT FttRTHER RESOLVED that true copies of this resolution he
transmitted to the Honorable Benjamin J. Cayetano, Lieutenant
Governor of the State of Hawaii and Mr. John ATagner, County Clerk,
County of Hawaii.
