HomeMy WebLinkAboutRES 286 Draft 02 1988-1992COUNTY OF HAWq~ _ : _~S'T'ATE OF HAWAII RESOLUTION No. z8G ~1 (DF11FT 2) WHEREAS, Section 2-114 of the Hawaii County Code provides that real property which is owned by the County of Hawaii may be sold or leased through negotiations upon a finding by the County Council that such transactions are in the public interest and that the public interest justifies such transactions; and WHEREAS, Article X, Section 10-14 (e) of the Hawaii County Charter provides that purchases of services may be negotiated without advertising if the public exigency will not admit to the delay incident to advertising and if such negotiations will promote the effective, efficient and timely procurement of goods and services; and WHEREAS, the State of Hawaii has indicated that it is willing to set aside approximately 200 acres of state-owned real property in Kealakehe, North Kona, County and State of Hawaii for a public golf course and related facilities and leaching field effluent water from the Kailua-Kona sewage treatment plant as part of the Kealakehe Planned Community project (which is a project of the State of Hawaii Housing Finance and Development Corporation); and WHEREAS, the County of Hawaii desires to accept the real property from the State of Hawaii and to lease the real property to a golf course developer and operator who will not only design, construct, develop, operate and maintain a public golf course and related facilities on the real property but also will receive, accept and utilize a minimum of one million gallons of effluent water per day from the Kailua-Kona sewage treatment facility as part of its activities; and WHEREAS, advertisements seeking competitive proposals were published and competitive proposals were received and review by the County of Hawaii, the most advantageous of which is the proposal of Kealakehe Associates, Inc., a Hawaii corporation; and WHEREAS, as part of the proposal, the County of Hawaii, with the prior approval of the State of Hawaii, desires to lease to Kealakehe Associates, Inc. the subject real property for the purpose of constructing, developing, operating and maintaining a public golf course and related facilities and leaching filed for effluent water from the Kailua-Kona sewage treatment plant. ZS~ Sit (DRAFT 2) NOW, THEREFORE, HE IT RESOLVED HY THE COUNCIL OF THE COUNTY OF HAWAII that the Director of Finance is hereby authorized to take such steps as may be necessary to accept the subject real property from the State of Hawaii and to enter into such contracts and lease agreements with Kealakehe Associates, Inc., a Hawaii corporation, for the purpose of allowing Kealakehe Associates, Inc. to construct, develop, operate and maintain a public golf course and related facilities on the subject real property and a leaching field for effluent water from the Kailua-Kona sewage treatment plant. BE IT FURTHER RESOLVED that after the contract negotiations for the lease has been finalized by the Administration, that that document be brought back to the Council.
