COUNTY OF HAWAII STATE OF HAWAII
RESOLUTION
WHEREAS, the County of Hawaii has entered into an agreement
with the Kealakehe Associates, Inc., whereby the County will lease
certain real properties in Kona, Hawaii, to Kealakehe Associates,
Inc, which Kealakehe Associates, Inc. will develop, operate, and
maintain as a public golf course; and
WHEREAS, as part of this agreement, Kealakehe Associates,
Inc. has agreed to pay Hawaii County the sum of $4 million; and
WHEREAS, the construction and operation of said public golf
course will burden the infrastructure of North and South Kona, and
place further demands on the County of Hawaii to provide services
in the North and South Kona districts; and
WHEREAS, use of said $9 million within the North and South
Kona districts will ameliorate the adverse impacts on the North
and South Kona infrastructure caused by the construction and
operation of the public golf course.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that the $4 million received from the Kealakehe
Associates, Inc., pursuant to their contract with the County of
Hawaii for the construction and operation of a public golf course,
shall be utilized only within the North and South Kona districts
for infrastructure development.

Your Committee on Finance, to which was referred Resolution
No. 299-91, reports as follows:
The purpose of Resolution No. 299-91 is to request that $4 million
received from the Kealakehe Associates, Inc., pursuant to their
contract with the County of Hawaii for the construction and
operation of a public golf course, shall be utilized only within the
North and South Kona districts for infrastructure development.
Your Committee recognizes that construction and operation of planned
public golf course will burden the infrastructure of North and South
Kona and necessitate additional County services be provided to these
districts.
Your Committee discussed whether subject funds from Kealakehe
Associates were in fact "premiums" or "impact fees". Your Chair
noted it was a legal question to be decided by Corporation Counsel.
Your Committee further discussed the merits of enlarging the scope
of the proposed resolution to include West Hawaii as opposed to
North and South Kona, but decided the funds should be used to
address the specific area impacted by the proposed development.
Your Committee on Finance concurs with the intent of Resolution
No. 299-91 and recommends its adoption.
