RESOLUTION No• (DRAFT a RELATING TO "IMPROVEMENT DISTRICT NO. 17 - KALOKO SUBDIVISION," KALOKO, DISTRICT OF KONA, HAWAII, CONDITIONALLY ACCEPTING A BID FOR WORK TO BE PERFORMED IN AND FOR SAID IMPROVEMENT DISTRICT. WHEREAS, advertisement for bids upon proposal for streets, drainage, street lighting, electrical system, water transmission and water reservoir facilities in and for "Improvement District No. 17 - Kaloko Subdivision," Kaloko, District of Kona, County of Hawaii, having been made, and the time for receiving bids therefor having expired on April 11, 1991, and competitive bids for the proposed improvements having been received, opened by the Chief Engineer and submitted to this Council for Job No. P-2907, Kaloko Roadway Improvement Project, and for Job No. P-2908, Kaloko Water Tanks, as summarized in Exhibit "A", attached hereto and incorporated herein; and, WHEREAS, the lowest responsible and reliable bidder for the improvements to be constructed under Job No. 2907 is Kiewit Pacific Company, which bidder has offered to furnish and pay for all material, including tools, equipment and labor necessary to construct and fully complete said Job No. 2907 for the total sum of $5,364,328.00; and, WHEREAS, the lowest responsible and reliable bidder for the improvements to be constructed under Job No. 2908 is Jas W. Glover, Ltd., which bidder has offered to furnish and pay for all material, including tools, equipment and labor necessary to construct and fully complete said Job No. 2908 for the total sum of $5,287,000.00; and, WHEREAS, after due consideration by this Council, it is deemed advisable to conditionally accept the bid of Kiewit Pacific Company for Job No. 2907 and the bid of Jas W. Glover, Ltd. for Job No. 2908 on the basis of the terms set forth below and as set forth in the form duly advertised and agreed to by said bidders. NOW, THEREFORE, be it Resolved by the County Council of the County of Hawaii; I. That the proposal for construction of the improvements, as submitted by Kiewit Pacific Company, to furnish and pay for all material, including tools, equipment and labor, necessary to construct and fully complete Job No. 2907 and the proposal for construction of the improvements, as submitted by Jas W. Glover, Ltd., to furnish and pay for all material, including tools, equipment and labor, necessary to construct and fully complete Job No. 2908, in and for "Improvement District No. 17 - Kaloko Subdivision," Kaloko, District of Kona, Hawaii, as set forth in the specifications attached to said proposals, be and the same are hereby accepted by this Council, contingent upon the further progress of the proceedings relating to said "Improvement District No. 17" and receipt of proceeds from the sale of Improvement District bonds for the Improvement District, at which -2- time the final awards of contracts will be made to said bidders, and upon the understanding that said bidders will thereupon execute contracts for the work and furnish bonds as required by law and said specifications. II. That the County Clerk is hereby authorized and directed to notify said bidders of the action taken herein and of the conditional acceptance of their bids on their proposal for said improvements, according to the terms thereof. III. That the County clerk shall transmit copies of this resolution to the Petitioner and the Chief Engineer. Dated at Hilo, Hawaii, this 17th day of April 1991. We have attached a summary of the bids submitted for Job No. 2907, Kaloko Roadway Improvement Project, and for Job No. 2908, Kaloko Water Tanks. For Job No. 2907, we recommend that the bid submitted by the low bidder, Kiewit Pacific Company, in the amount of $5,364,328.00 be accepted. For Job No. 2908, we recommend that the bid submitted by the low bidder, Jas. W. Glover, Ltd., in the amount of $5,287,000.00 be accepted.
