RESOlUT10N No. 313 91
WHEREAS, Chapter 286, Part XIII, Commercial Driver Licensing,
HRS, takes effect on April 1, 1991; and
WHEREAS, the Commercial Motor Vehicle Safety Act of 1986 (CMVSA),
more particularly 79 App. U.S.C. Sec 2708, specifies that in order to
avoid withholding of federal highway construction and improvement
funds, the states shall implement the CMVSA by October 1, 1993; and
WHEREAS, CMVSA requires a comprehensive statewide computerized
commercial motor vehicle operation information system to enable the
State of Hawaii to determine the qualifications of individuals who
apply for a commercial motor vehicle driver's license and to have
immediate access, through the commercial driver's license information
system (CDLIS), national driver records of commercial motor vehicle
driver's applications; and
WHEREAS, Act 320, SLH 1989, requires the Counties to administer
all commercial driver's license (CDL) testing and licensing
requirements; and
WHEREAS, Article V, Section 5-1.9(c) states that the Mayor has
the power to "Create positions...for which appropriations have been
made by the council..."; and
WHEREAS, in order to carry out the CDL program, the following
positions need to be created:
1 CDL Driver License Examiner Supervisor SR-18
2 Driver License Examiner II SR-17
1 MV Financial Responsibility Clerk-Steno SR-12
4 Senior Clerk SR-10
and
WHEREAS, funds will be reimbursed by the State Department of
Transportation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the following positions be created:
1 CDL Driver License Examiner Supervisor SR-18
2 Driver License Examiner II SR-17
1 MV Financial Responsibility Clerk-Steno SR-12
4 Senior Clerk SR-10
BE IT FURTHER RESOLVED that funds for the newly created positions
will be reimbursed by the State Department of Transportation.
BE IT FURTHER RESOLVED that a copy of this resolution be
transmitted to the Departments of Police, Civil Service and Finance.
