RELA'PING TO PERMANENT IMPROVEMENTS IN THE KALOKO SUBDIVISION,
KALOKO, DISTRICT OF NORTH KONA, COUNTY OF HAWAII, ACCEPTING AND
ADOPTING THE AMENDMENTS TO THE PETITION FOR "IMPROVEMENT
DISTRICT N0. 17 - KALOKO SUBDIVISION," KALOKO, DISTRICT OF NORTH
KONA, COUNTY OF HAWAII, PROVIDING FOR THE IMPROVEMENTS.
WHEREAS, on December 19, 1986, TSA International Ltd.
(Petitioner) filed a Petition with the County Council in accordance
with the provisions of Section 12-16, Hawaii County Code, which
Petition was duly acknowledged by Petitioner as the owner of one
hundred percent (1000 of the area of land designated in the
Petition as a proposed improvement district (there being no lessees
of any of the land within the meaning of Section 12-16, Hawaii
County Code); and
WHEREAS, the Petition requests construction of the special
improvements and contains the surveys, maps, plans and other
preliminary data and estimates described in Section 12-10, Hawaii
County Code, as in the case of a proceeding initiated by the Council
pursuant to Section 12-10, Hawaii County Code; and
WHEREAS, the Petition was accepted and adopted by the County
Council by Resolution Pdo. 249-90 Draft 2; and
WHEREAS, the Petitioner has submitted an Amendment to the
Petition dated November 3, 1990, a Second Amendment to Petition
dated May 3, 1991, a Third Amendment to Petition dated May 15, 1991
a Fourth Amendment to Petition dated May 28, 1991, and a Fifth
Amendment to Petition dated June 10, 1991, which are attached hereto
as Exhibits A-1, A-2, A-3, A-4 and A-5, respectively, and
incorporated into this resolution; and
WHEREAS, the Council has examined and considered the submitted
amendments to the Petition which are incorporated for information
within the Compendium of Petition and Amendments as submitted on
June 13, 1991 and as attached hereto as Exhibit B.
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the said Amendments to the Petition, attached hereto and
incorporated herein as Exhibits A-1, A-2, A-3, A-4 and A-5, are
hereby accepted and adopted.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
shall transmit copies of this resolution to the Petitioner and the
Chief Engineer.
