RESOLUTION AMENDING THE FUEL TAX INCREASE EXPENDITURE PLAN.
WHEREAS, Resolution 397-88, which was adopted by the Hawaii
County Council on March 15, 1988, provided an additional 3.8 cents
per gallon in fuel tax revenues for road resurfacing projects over a
ten-year period; and
G?HEREAS, Resolution 397-88 also provided that the $1,500,000 in
additional annual revenues would be distributed and expended in
accordance with a district distribution formula and a five-increment
project plan as delineated in the attached Exhibit A of said
resolution; and
wHERF,AS, Resolution 397-88 mandated that the apportionment
formula be updated bi-annually; and
WHEREAS, Committee on Public Works Report No. 142, which was
adopted by the County Council at its May 1, 1991 meeting
acknowledged the success of the fuel tax increase in providing for
an improved highway resurfacing program, however, said report also
recognized that further improvements could be realized with
modifications; and
PIHEREAS, the Committee on Public Works, at its July 9, 1991
meeting, further discussed the fuel tax increase program and
acknowledged the following:
The distribution formula does not necessarily reflect the use
demands placed upon certain roadways, especially those primary
roadways which are subject to more than localized traffic;
The Department of Public Works, due to staff shortages, is
experiencing difficulty in executing the program in an efficient
and timely manner; and
WHEREAS, excess revenues are available for further
appropriations due to revenues exceeding initial estimates.
NOR?, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it hereby amends the fuel tax expenditure plan as
follows:
1. Proceeds from the fuel tax increase shall be expended in
accordance with various appropriation ordinances. Said
ordinances shall delineate appropriation as incremental or
primary road projects.
2. Exhibit A, as attached to Resolution 397-88, shall hereafter
serve as an expenditure guideline in determining incremental
projects for appropriations.
3. Revenues in excess of the monthly amount projected for any
increment shall be available for allotment to those circle
island roadways as delineated in Schedule A as herein attached.
4. When deemed necessary by the Chief Engineer appropriations
may be applied toward the hiring of consultants for the
prosecution of a particular project.
5. The district distribution formula shall hereafter be updated
biennially.
BF, IT FURTHER RESOLVED that in keeping with the desires of the
Council to modify the expenditure plan to allow for inflation,
consultant work and a 10~ contingency, increment allotments are
adjusted as follows:

BE IT FURTHER RESOLVED that in keeping with the intent
periodically update the distribution formula, the district
distribution formula, as originally established by Exhibit
Resolution 397-88, is hereby amended as follows:

BE IT FURTHER RESOLVED that the district distribution formula
shall apply to the amounts specified in the various increments and
does not necessarily apply to the major road appropriations.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii
transmit a copy of this Resolution to the Honorable Lorraine R.
Znouye, Mayor; Mr. Bruce C. McClure, Chief Engineer and Mr. William
Takaba, Director of Finance.

RESOLUTION AMENDING THE FUEL TAX INCREASE EXPENDITURE PLAN
WHEREAS, Resolution 397-88, which was adopted by the Hawaii
County Council on March 15, 1988, increased the Hawaii County Fuel
Tax by 3.8 cents per gallon; and
WHEREAS, Resolution 397-88 also established the basic
criteria for the use of proceeds from the fuel tax increase and
those criteria are summarized as follows:
Proceeds would be distributed in accordance with a district
apportionment formula,
Proceeds would be spent for highway improvements and be based
upon the projects as delineated in Exhibit A of Resolution 397-88,
Tax increase would remain in effect for ten years, and
Formula updates would be done biannually; and
WHEREAS, at the May 1, 1991 County Council meeting, Public
Works Committee Report No. 142 was adopted and said report
acknowledged that while the fuel tax increase has been successful
in addressing the need for highway improvements, the program could
be improved with modifications; and
WHEREAS, Public Works Committee Report No. 142 recognized the
following needs:
Incremental funding of projects is not the most efficient
means to complete projects and that the department should be
allowed to proceed with district projects as delineated by a
priority list,
Staff engineers are not keeping pace with the design work,
and the department should be allowed to contract for design work
and said contract fee should be a part of the project cost, and
Biannual update of the district apportionment formula should
be corrected to reflect a requirement for a biennial update; and
WHEREAS, the County Council concurs with the Public Works
Committee Report No. 142 that the fuel tax increase project list
as delineated in Exhibit A needs to be reassessed and that the
program could prove to be more effective with certain
modifications;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that it hereby amends the fuel tax increase expenditure
plan, as delineated in Resolution 397-88 and Exhibit A of
Resolution 397-88.
BE IT FURTHER RESOLVED that in keeping with the need to
maintain a flexible and responsive expenditure plan, said plan
shall consist of the various appropriating ordinances as hereafter
authorized.
BE IT FURTHER RESOLVED that the requirement for biannual
updates of the distribution formula is hereby amended to require
biennial updates.

BE IT FURTHER RESOLVED that the distribution formula as
originally established by Exhibit A of Resolution 397-88 is hereby
amended as follows:

BE IT FURTHER RESOLVED that the aforementioned distribution
formula shall be effective with the commencement of projects as
delineated in Increment II.
BE IT FURTHER RESOLVED that the County Clerk transmit a copy
of this Resolution to the Honorable Lorraine R. Inouye, Mayor,
Mr. Bruce C. McClure, Chief Engineer, and Mr. William Takaba,
Director of Finance.
