WHEREAS, chapter 2, article 19, section 2-120(a)(1), Hawaii County Code, as amended, provides that: the Council may, by resolution approved by a majority of its members, direct the finance director to negotiate the disposition of real property by selling it in fee simple at such price and on such terms and conditions deemed proper to governments and governmental agencies authorized to hold lands in fee simple; and WHEREAS, chapter 2, ar.tieie 15, sectior. 2-120(b), Hawaii County Code, as amended, provides that a disposition of real property to governments or govei.-::n:ental agencies may be made without the notice o.r appraisal otherwise required by article 19; and WHEREAS, the Country owns 'i'1QK: 5-^-09:04 which was obtained from Kohala Corporation as a chaLitable contribution for exclusively public purposes; and VI}iERF_AS, the State rf Iiewaii, :~et~artment ci Defense, owns TMK: 5-4-05:51 which is the rr~ae,a site of cl:a Hawaii Army National Guard Armory; and WHEREAS, tY:e State: of H(1Wa1)., Dapar.'~ment of Defense, has requested the tram:f.er of 5.OlES acres o~ the 10.L51 acres which comprise TMK: 5-~,-09:C4 ownc:l by the County of Hawaii for the purpose of expanding the Hawaii Army National Guard Armory site to permit construction of a new armory; and WHEREAS, the construction of a new armory will enhance the readiness of the Hawaii Army National Guard unit stationed at Kapaau, North Kohala, and will also benefit the local community by a general enhancement of the Kamehameha Park area; and WHEREAS, the County desires to give the necessary consent to transfer 5.018 acres of the 10.251 acres which comprise TMK: 5-4-09:04 on the terms and conditions set forth in the deed which is attached as Exhibit "A", NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII THAT: in accordance with the provisions of chapter 2, article 19, sections 2-120(a)(1) and 2-120(b), Hawaii County Code, as amended, the director of finance is authorized to transfer 5.018 acres of County property TMK: 5-9-09:04 to the State of Hawaii for the purpose of expanding the Hawaii Army National Guard Armory complex, Kapaau, North Kohala, Hawaii.
