RESOLUTION AUTHORIZING THE EMPLOYMENT OF THE LAW FIRM OF PAUL,
JOHNSON, PARK & NILES TO REPRESENT THE COUNTY OF HAWAII BEFORE
THE PUBLIC UTILITIES COMMISSION IN THE PROCEEDINGS REQUIRING
ENERGY UTILITIES IN HAWAII TO IMPLEMENT INTEGRATED RESOURCE
PLANNING.
WHEREAS, the Public Utilities Commission (PUC) through Docket
No. 6617 has instituted a proceeding to require energy utilities
in Hawaii to implement Integrated Resource Planning (IRP); and
WHEREAS, pursuant to PUC Order No. 10651 filed on May 31,
1990, the County of Hawaii's motion to intervene and become a
party to the proceedings in Docket No. 6617 was granted by the
PUC; and
WHEREAS, the County of Maui and the law firm of Paul,
Johnson, Park & Niles (the "Attorney") entered into a contract to
render certain special and unique legal and technical services to
Maui County in connection with the IRP proceedings; and
WHEREAS, the County of Kauai, through the Office of the
Economic Development, and the County of Hawaii, through the
Department of Research and Development, also desire to hire the
attorney as special counsel and technical consultants for the same
proceedings; and
WHEREAS, the services of said special counsel are necessary
to complete the IRP proceedings; and
WHEREAS, the services to be rendered are unique, unusual,
technical and professional in nature and accordingly do not admit
of competition; and
WHEREAS, the IRP proceedings is a special matter presenting a
real necessity for the employment of special counsel; and
WHEREAS, the Counties of Maui, Kauai, and Hawaii desire to
equally share the costs of retaining the attorney in the IRP
proceedings; and
WHEREAS, the attorney is willing to represent the parties.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that the County of Hawaii shall retain the law firm of
Paul, Johnson, Park & Niles to represent the County before the
Public Utilities Commission in the proceedings requiring energy
utilities in Hawaii to implement integrated resource planning.
BE IT FURTHER RESOLVED that the County of Hawaii shall
reimburse the County of Maui for the services of the law firm of
Paul, Johnson, Park & Niles in the amount of $12,044.00.
