RESOLUTION No. ~~ 91 WHEREAS, on March 16, 1983, the Hawaii County Council adopted Resolution No. 572-83 designating the "Davies Neighborhood Revitalization Project", which included the Kapehu Camp area, the Kekoa Camp and the Papaaloa Elderly Housing site area, and the Waipunalei Camp area as an Experimental and Demonstration project area, and WHEREAS, on June 20, 1984, the Hawaii County Council adopted Resolution No. 933-84 which approved preliminary plans and specifications for the Kapehu Camp Increment I and Papaaloa Elderly Housing Phase I areas as provided for under Section 46-15, Hawaii Revised Statutes, and WHEREAS, the Hamakua Sugar Company (Hamakua) purchased the plantation from Davies Hamakua Sugar Company (Davies), a division of Theo. H. Davies & Co., Ltd., and WHEREAS, Hamakua changed their "Housing Policy" and decided: 1.) NOT to continue with the development of Kapehu Camp Increment II; 2.) NOT to continue with the renovation and sale of Kekoa Camp and Waipunalei Camp; and 3.) to hold off dedication of the remaining 2.5+ acres of the Papaaloa Elderly Housing site (Phase II); because Hamakua decided to keep its employee company housing, and WHEREAS, William and Jessie Anderson (Andersons) purchased the Papaaloa Elderly Housing Phase II site from Hamakua through a Realtor (See Exhibit A attached for location of site.), and WHEREAS, the Andersons feel that the land area required for dedication of an drainage easement is too large an area to be dedicated to the County for drainage purposes, and WHEREAS, the Andersons also refused to give the County liability waivers to maintain the drainage Swale and sump for drainage purposes, and WHEREAS, the Office of Housing and Community Development and the Office of the Corporation Counsel have unsuccessfully tried several options to resolve this issue, and WHEREAS, the Andersons wish to subdivide the property for purposes other than experimental and demonstration affordable housing. NOW THEREFORE BE ZT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Council Resolution 572-83 and Council Resolution 933-84 be amended to remove only approximately 2.5 acres of land from the experimental and demonstration designation from the Kekoa Camp and Papaaloa Elderly Housing area, with the understanding that the County and any future heirs or assigns to the property will not be held liable for any existing storm and drainage flows generated from within the Papaaloa Elderly Housing Phase I site and from any existing storm and draingage flows that currently flow through the Papaaloa Elderly Housing Phase I site. BE IT FURTHER RESOLVED that the County Clerk be directed to forward true copies of this Resolution to the William and Jessie Anderson, Hamakua Sugar Company and the Office of Housing and Community Development.
