RELATING TO "IMPROVEMENT DISTRICT NO. 17 - KALOKO
SUBDIVISION," KALOKO, DISTRICT OF NORTH KONA, COUNTY OF HAWAII,
FINALLY ACCEPTING BIDS AND AWARDING CONSTRUCTION CONTRACTS FOR
WORK TO BE PERFORMED IN AND FOR SAID IMPROVEMENT DISTRICT.
WHEREAS, the County Council, pursuant to Resolution No.
301-91, conditionally accepted the bid of Kiewit Pacific Company
in the amount of $5,364,328.00 for Job No. 2907 (Kaloko Roadway
Improvement Project) and the bid of Jas. W. Glover, Ltd. in the
amount of $5,287.000.00 for Job No. 2908 (Kaloko Water Tanks) for
the construction of the improvements in and for Improvement
District No. 17; and,
WHEREAS, subsequent to the adoption of Resolution No.
301-91, the Department of Public Works and the Department of
Water Supply determined that the scope of work for Job No. 2908
should be reduced; and,
WHEREAS, the Department of Public Works, the Department
of Water Supply, Petitioner TSA International, Ltd. and Jas. W.
Glover, Ltd. have agreed on the reduction in the scope of work
and have further agreed to a revised bid amount of $4,367,000.00
for Job No. 2908; and,
WHEREAS, Resolution No. 301-91 conditioned the final
acceptance of the bids and award of the contracts for Job No.
2907 and Job No. 2908 upon further progress of the proceedings
relating to the Improvement District and upon the receipt of the
proceeds from the sale of the Improvement District bonds; and,
WHEREAS, the County Council, pursuant to Resolution No.
343-91, approved the sale of the Improvement District bonds to
Shearson Lehman Brothers Inc.; and,
WHEREAS, the County of Hawaii received the proceeds
from the sale of the Improvement District bonds on August 22,
1991.
NOW, THEREFORE, be it Resolved by the County Council of
the County of Hawaii as follows:
1. The bid of Kiewit Pacific Company in the amount of
$5,364,328.00 for Job No. 2907 is hereby accepted and the
construction contract for said job in said amount is hereby
awarded to Kiewit Pacific Company.
2. The revised bid of Jas. W. Glover, Ltd. in the
amount of $4,367,000.00 for Job No. 2908 is hereby accepted and
the construction contract, as reduced in scope, for said job in
said amount is hereby awarded to Jas. W. Glover, Ltd.
3. On or before August 30, 1991, the Chief Engineer,
Department of Public Works shall notify Kiewit Pacific Company
and Jas. W. Glover, Ltd. of the aforesaid acceptance of bids and
award of contracts in accordance with the procedures applicable
to County of Hawaii construction projects.

4. The County Clerk shall transmit copies of this
resolution to Petitioner TSA International, Ltd., the Chief
Engineer and the Manager, Department of Water Supply.
