Home My WebLink AboutRES 380 Draft 02 1988-1992COUNTY OF HAWAIF STATE OF HAWAII RESOLUTION N0. 38J 91 (DRAFT L) WHEREAS, Kaloko-Honokohau National Historical Park was established in 1978 under Public Law 95-625; and WHEREAS, the Kaloko-Honokohau National Historical Park was established in order to provide a center for the preservation, interpretation and perpetuation of traditional Native Hawaiian activities and culture; and WHEREAS, Kaloko-Honokohau is one of the few remaining sites in Hawaii where one can truly see how the Native Hawaiians built their homes, provided food for their families through fishpond culture, lived their lives, and honored their dead; and WHEREAS, it is our responsibility as fellow inhabitants of these islands to perpetuate the heritage of the Ancient Hawaiian who worked the land and sea, worshiped their gods and pursued their lives in the entire area now designated as the Kaloko-Honokohau National Historical Park; and WHEREAS, the Kaloko-Honokohau National Historical Park boundaries were also established to demonstrate historic land use patterns as well as to provide a needed resource for the education, enjoyment, and appreciation of traditional Native Hawaiian activities and culture by local residents and visitors; and WHEREAS, Kaloko-Honokohau is a place where all people of our times, young and old, can experience the true essence of the Hawaiian people and should be protected and preserved for future generations as a natural monument to the way of the life in early Hawaii; and WHEREAS, the Kaloko-Honokohau National Historical Park is home to the endangered Hawaiian Stilts and Hawaiian Coots, marine mammals and Sea Turtles, 'Opae-'Ula, rare types of snails, and native plants like Naio, Noni, Kou and others; and WHEREAS, it is of extreme importance to recognize the significant cultural, environmental and recreational value of the whole Kohanaiki area; and WHEREAS, a 3,500-foot strip of coastal land 300-feet wide on a private owner's property was also included within the Congressionally authorized boundary of Kaloko-Honokohau National Historical Park; and WHEREAS, the National Park Services has not yet acquired the 300-foot wide strip for the Kaloko-Honokohau National Historical Park; but has been mandated by Congress to acquire the parcel for expansion of the park; and WHEREAS, Kaloko-Honokohau is an ancient Hawaiian dwelling place that has remained virtually untouched by intruders and affected only by the relentless forces of nature, and is an historic and cultural treasure which is presently endangered by commercial and resort development; and WHEREAS, this legislation is currently pending action in the House Committee on Interior and Insular Affairs; and WHEREAS, further legislation may be introduced to extend National Park Service jurisdiction to include the shoreline of Kohanaiki known as "Pinetrees". NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it urges the Federal Government negotiate with the landowner for the acquisition of the 3,500 feet from the Kaloko-Honokohau National Historical Park northern, ocean boundary to Wawahiwaa Point. BE IT FURTHER RESOLVED that Congress consider the availability of funds, for acquisition of private land, development of the existing park lands and whether the State Land use conditions presently imposed on the landowner would meet the needs and intent of the Kaloko-Honokohau National Historic Park. BE IT FURTHER RESOLVED that we further endorse that the National Park Service be directed to preserve and maintain Kohanaiki's shoreline for public recreation and access through further legislation and that this Council objects to any admission charge or restrictions be placed on shoreline access for residents if the private lands are acquired as part of a national park. BE IT FURTHER RESOLVED that the Hawaii County Council further objects to the Federal Government land banking the shoreline area owned by Nansay (zoned Resort) and that the purchase of this land be negotiated immediately. O A C _ Z' ~ n y r :o N - _ \ J . l 0 ~ ~ N P V = N - moo:. , wve :<; - *u ~~ COUNTY OF HAWAII RESOLUTION NO STATE OF HAWAII 38c~ 91 WHEREAS, Kaloko-Honokohau National Historical Park was established in 1978 under Public Law 95-625; and WHEREAS, the Kaloko-Honokohau National Historical Park was established in order to provide a center for the preservation, interpretation and perpetuation of traditional Native Hawaiian activities and culture; and WHEREAS, Kaloko-Honokohau is one of the few remaining sites in Hawaii where one can truly see how the Native Hawaiians built their homes, provided food for their families through fishpond culture, lived their lives, and honored their dead; and WHEREAS, it is our responsibility as fellow inhabitants of these islands to perpetuate the heritage of the Ancient Hawaiian who worked the land and sea, worshiped their gods and pursued their lives in the entire area now designated as the Kaloko-Honokohau National Historical Park; and WHEREAS, the Ka boundaries were also use patterns as well education, enjoyment, Hawaiian activities visitors; and Loko-Honokohau National Historical Park established to demonstrate historic land as to provide a needed resource for the and appreciation of traditional Native and culture by local residents and WHEREAS, Kaloko-Honokohau is a place where all people of our times, young and old, can experience the true essence of the Hawaiian people and should be protected and preserved for future generations as a natural monument to the way of the life in early Hawaii; and WHEREAS, the Kaloko-Honokohau National Historical Park is home to the endangered Hawaiian Stilts and Hawaiian Coots, marine mammals and Sea Turtles, 'Opae-'Ula, rare types of snails, and native plants like Naio, Noni, Kou and others; and WHEREAS, it is of extreme importance to recognize the significant cultural, environmental and recreational value of the whole Kohanaiki area; and WHEREAS, a 3,500-foot strip of coastal land 300-feet wide on a private owner's property was also included within the Congressionally authorized boundary of Kaloko-Honokohau National Historical Park; and WHEREAS, the National Park Services has not yet acquired the 300-foot wide strip for the Kaloko-Honokohau National Historical Park; but has been mandated by Congress to acquire the parcel for expansion of the park; and WHEREAS, Kaloko-Honokohau is an ancient Hawaiian dwelling place that has remained virtually untouched by intruders and affected only by the relentless forces of nature, and is an historic and cultural treasure which is presently endangered by commercial and resort development; and WHEREAS, the U.S. Representatives from the State of Hawaii have co-sponsored H.R. 3140 in the House of Representatives, a bill to direct the Secretary of the Interior to acquire by condemnation the 25-acre shoreline within the Congressionally designated boundaries of Kaloko-Honokohau National Historical Park; and WHEREAS, this legislation is currently pending action in the House Committee on Interior and Insular Affairs; and WHEREAS, further legislation may be introduced to extend National Park Service jurisdiction to include the shoreline of Kohanaiki known as "Pinetrees". NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it endorses H.R. 3140, Federal Government acquisition of the 300-foot wide coastal strip extending approximately 3,500 feet from the Kaloko-Honokohau National Historical Park northern, ocean boundary to Wawahiwaa Point. Your Committee finds that the property is currently owned by Nansay Hawaii and that the property is part of a larger parcel which was previously zoned by the Council of the County of Hawaii as Resort. Your Committee has accepted testimony from Nansay Nawaii in opposition to HR 3140 and Hawaii County Council Resolution 380-91. Nansay's concerns were: 1. The proposed area for acquisition is not clearly described as part of the National Park boundary; 2. The proposed a::ea has been evaluated numerous times by government agencies. The State Land Use Commission has evaluated the parcel. Hawaii County has adopted General Plan amendments and recognizes resort zoning for the area; 3. Nansay Hawaii purchased the property after it was zoned resort; 4. Kohanaiki is an extremely active ocean recreational area. Placing the area in and part of a National Historic Park may limit the use of the area. IGR REPORT No, 10l ADOPTED: IGR- 101 Page 2 October 8, 1991 Several members of your Committee are concerned about keeping the ocean areas accessible to the public. Your Committee has been assured by Nansay of their commitment to keeping the area open. Nansay further submitted that their public access plan is on file with the Planning Director of the County of Hawaii. While no similar assurances of continued public access were solicited from the Department of Interior, recent park actions in limiting access hours and the imposition of visitor fees at selected National Parks make federal ownership less desirable. Other concerns included the implied rezoning affect of the resolution and the potential loss in taa revenues if properties were rezoned to a lesser use. A motion recommending approval and adoption of Resolution No. 380-91 by the full Council was defeated.
