AUTHORIZING THE NEGOTIATION AND EXECUTION OF AN AGREEMENT
FOR THE KALAOA VIEW ESTATE HOUSING PROJECT
WHEREAS, the Office of Housing and Community Development
(hereinafter "OHCD") and the Kalaoa Partners (hereinafter "KP")
mutually desire to combine their resources to develop land iden-
tified as TMK: 7-3-03: 12, to provide decent, safe, and
sanitary housing to qualified individuals of the County of
Hawaii; and
WHEREAS, by virtue of Chapter 46-15.1, Hawaii Revised
Statutes (HRS), as amended, and by the regulations related
thereto, the County is empowered to develop real property, either
by itself, on behalf of the State of Hawaii, or in partnership
with qualified developers or contractors; and
WHEREAS, by virtue of Chapter 2, Article 13, Section 2-70 of
the Hawaii County Code of the County of Hawaii, the County is
empowered to develop and construct dwelling units, alone or in
partnership with developers or contractors; and
WHEREAS, the County hereby acknowledges that: (1) KP is an
acceptable and qualified partner in satisfaction of the
requirements of Chapter 201E of the HRS, and (2) the Kalaoa area
is a good and proper choice for housing development; and
WHEREAS, KP hereby acknowledges that the County is an
acceptable and qualified partner in satisfaction of the
requirements of Chapter 2, Article 13, Section 2-70 of the Hawaii
County Code; and
WHEREAS, KP and the County desire to provide affordable
housing for residents of the County of Hawaii; and
WHEREAS, prerequisite conditions have been met which
necessitate the development of the Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that the Housing Administrator of the County of Hawaii
is hereby authorized to negotiate and the Mayor is hereby
authorized to execute an Agreement with Kalaoa Partners to
provide fee simple lots affordable to families earning below
80 percent (80$) and up to 140 percent (140$) of the County's
median family income and single-family rental units to be rented
at terms and conditions for participation in the Housing and
Urban Development's (HUD) Section 8 rental assistance program for
the County of Hawaii in Kalaoa, North Kona, Hawaii.
BE IT FURTHER RESOLVED, that the Housing Administrator is
hereby authorized to provide such additional information as may
be required and to act as the authorized representative of the
Hawaii County Housing Agency in connection with the development
of the Kalaoa View Estate Housing Project.

SUBJECT: Kalaoa View Estate Housing Project
Resolution for the Hawaii County Council
The OHCD has submitted to the HCHA a Resolution Authorizing the
Mayor to Execute an Agreement to Develop the Kalaoa View Estate
Housing Project.
The HCHA has reviewed and approved the Resolution at its meeting
on December 18, 1991. Accordingly, I am requesting that the
attached Resolution be included on the Council agenda for action
at its next Council meeting.
