(DRAFT 2) RESOLUTION APPROVING THE TRANSIT CAPITAL DEVELOPMENT AGREEMENT ENTERED INTO BY MAYOR LORRAINE R. INOUYE AND THE GOVERNOR OF THE STATE OF HAWAII PURSUANT TO CHAPTER 51, HAWAII REVISED STATUTES, AND CHAPTER 2, HAWAII COUNTY CODE, 1983 TO IMPROVE AND ENHANCE THE COUNTY OF HAWAII MASS TRANSPORTATION SYSTEM. WHEREAS, pursuant to Chapter S1D, Hawaii Revised Statutes, the State may provide dollar-for-dollar funding assistance to the County from the Transit Capital Development Fund to provide necessary funds to develop mass transportation systems; and WHEREAS, the County of Hawaii seeks to enhance, improve and expand its mass transit system through its Transportation Capital Enhancement Project to continue to provide the people of Hawaii County with safe, reliable, efficient and convenient service, facilities and equipment; and WHEREAS, the Transportation Capital Enhancement Project proposes to acquire 30 vehicles and related maintenance equipment amounting to $3,727,000, of which, $1,863,500 is sought under the provisions of the Transit Capital Development Fund, subject to the disapproval or adjustment of the State Legislature; and WHEREAS, the County's obligation of matching funds will consist of $1,863,500 in general fund revenues, subject to the approval of the fiscal year 1992-1993 operating budget; and WHEREAS, pursuant to Chapter S1D-5, Hawaii Revised Statutes, requires as a prerequisite of State financial assistance that the County enter into a Transit Capital Development Agreement with the Governor of the State of Hawaii, subject to the disapproval of the State Legislature; and WHEREAS, Ordinance 92-lOrequires the Hawaii County Council approve the Transit Capital Development Agreement by resolution, NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII THAT: in accordance with the provisions of Chapter 51, Hawaii Revised Statutes and Chapter 2, Hawaii County Code, 1983, the Transit Capital Development Agreement entered into on behalf of the County of Hawaii by Mayor Lorraine R. Inouye with the Governor of the State of Hawaii to improve and enhance the County~s mass transportation system meets with the approval of the Hawaii County Council and that the County will comply with all provisions and obligations imposed in connection with the Transit Capital Development Agreement including its local share of funding of the project cost.
