RESOLUTION
WHEREAS, on September 18, 1991, the County Council of the
County of Hawaii approved the designation of the Kawaihae
Homeless Shelter project as an experimental and demonstration
housing project, as provided by Section 46-15, HRS; and
WHEREAS, the designation of the. project under the authority
of Section 46-15, HRS, was for the purpose of providing liability
protection for the County; and
WHEREAS, the County liability concern is being adequately
covered by Section 358D-6, HRS; and
WHEREAS, all the exemptions granted by the Council under the
experimental and demonstration housing designation pursuant to
Section 46-15, HRS, will still apply under Section 201E-210, HRS.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII that Resolution 371-91 is hereby rescinded.
