RESOLUTION No. `~~~ ~~ RELATING TO THE EXCHANGE OF REAL PROPERTY LOCATED AT HONOHONONUI, DISTRICT OF SOUTH HILO, COUNTY OF HAWAII AND KEAUHOU, DISTRICT OF NORTH KONA, COUNTY OF HAWAII FOR REAL PROPERTY LOCATED AT HONOHONONUI, DISTRICT OF SOUTH HILO, COUNTY OF HAWAII. WHEREAS, the County of Hawaii's Hilo Wastewater Treatment Plant Project includes the construction and installation of a sewerline through real property located at Honohononui, South Hilo, identified as TMK:(3)2-1-13:146 and 147, which real property is owned by the Trustees of the Estate of Bernice Pauahi Bishop, which is a non-profit organization, (the "Bishop Estate real property"); and, WHEREAS, the County of Hawaii desires to obtain a fifty foot wide non-exclusive easement for sewerline purposes through the Bishop Estate real property as depicted on maps prepared by Inaba Engineering, Inc., dated March 28, 1990 (the "sewerline easement"); and, WHEREAS, the Trustees of the Estate of Bernice Pauahi Bishop are willing to grant the sewerline easement to the County of Hawaii in exchange for the County of Hawaii conveying in fee to the Trustees of the Estate of Bernice Pauahi Bishop real property located at Keauhou, North Kona, identified as TMK:(3) 7-8-10:37 (the "Heeia WTP") and real property located at Honohononui, South Hilo, being all of Kahaoi Road and the portion of Kamakuna Road makai of Laehala Street; and, WHEREAS, Section 2-120(a)(3), Hawaii County Code, permits the negotiated exchange of County-owned real property for real property owned by a non-profit organization. NOW, THEREFORE, be it Resolved by the County Council of the County of Hawaii as follows: 1. The Director of Finance is hereby directed, pursuant to §2-120, Hawaii County Code, to negotiate the exchange of the County of Hawaii's fee interest in the Heeia WTP, Kahaoi Road and the portion of Kamakuna Road makai of Laehala Street for the grant of the sewerline easement through the Bishop Estate real property from the Trustees of the Estate of Bernice Pauahi Bishop, which is a non-profit organization, upon such terms and conditions as the Director of Finance may deem appropriate. 2. The Director of Finance shall submit to the County Council for its approval and consent all such terms and conditions that he may negotiate and all documents of conveyance between the County of Hawaii and the Trustees of the Estate of Bernice Pauahi Bishop. 3. The County Clerk shall transmit copies of this resolution to the Chief Engineer, the Director of Finance and the Trustees of the Estate of Bernice Pauahi Bishop. Discussions have been ongoing for some time with representatives of Bishop Estate concerning the acquisition of an easement for this sewerline. Subject to Council approval, we have agreed to convey the Heeia Wastewater Treatment Plant, Kahaoi Road and a portion of Kamakuna Road in exchange for the sewerline easement. The exchange will be accomplished pursuant to §2-120(a)(3), Hawaii County Code. The first step under §2-120(a)(3), HCC, is for the Council to direct the Finance Director, by resolution, to negotiate the terms and conditions of the exchange. A resolution is attached far this purpose. The Heeia WTP, which serves the Keauhou area, is located on a parcel that was originally dedicated to the County by Bishop Estate. The Heeia system is unique in that the plant is owned by the County but the sewerlines are privately owned. The Heeia WTP is obsolete and will soon be replaced by a new wastewater treatment plant on an adjoining parcel. The new plant is being built anOnceltheeneweplant is operational, the Investment Corporation (KIC). County will have no use for the existing Heeia WTP• As the need arises, KIC intends to use the Heeia WTP parcel for expansion of the new plant. Kahaoi and Kamakuna Roads are located at Honohononui in the vicinity of the Hilo Yacht Club as shown on the attached tax map. All of the property abutting the two roads is owned by Bishop Estate. Over the years, Bishop Estate has experienced a continuing problem with trash being dumped onto its property from the roads. In addition, there have been many instances of the roads and abutting property being used as sites for drinking parties. Bishop Estate believes these problems can be diminished if the roads are under its ownership. cam, ~, 3 6 82 _ Toy PWC Honorable Russell S. Kokubun and Members of the Hawaii County Council Page 2 April 30,.1992 Further negotiations regarding the conveyance of the roads will focus on the reservation of an easement over Kamakuna Road for pedestrian access to the shoreline, the granting by Bishop Estate of an area near Kamakuna Road for public parking and the granting by Bishop Estate of a road right-of-way to extend Laehala Street in an easterly direction.
