RESOLUTION AUTHORIZING THE FINANCE DIRECTOR TO NEGOTIATE THE SALE
IN FEE SIMPLE OF REAL PROPERTY TO THE HAWAII HOUSING AUTHORITY
FOR THE DEVELOPMENT OF AFFORDABLE RENTAL UNITS AT WAIKOLOA.
WHEREAS, the County of Hawaii designated a site within the
Waikoloa Affordable Housing Project for the immediate development
of a multi-family rental project; and
WHEREAS, a master plan prepared by Nansay Hawaii for the
279-acre Waikoloa Village Affordable Housing Project identified
Site No. 19, consisting of approximately ten (10) acres, more
specifically described in the hereto attached map labeled
"Exhibit A," located adjacent and to the north of the Paniolo
Estates Subdivision, as the :cost feasible site for immediate
development; and
WHEREAS, there are three potential development projects
being considered for Site No. 19 which will provide Federal
and/or State subsidies for low income rental units in the South
Kohala district; and
WHEREAS, the preliminary project layout is identified in the
hereto attached map labeled "Exhibit B"; and
WHEREAS, Nansay Hawaii has submitted a low-income housing
tax credit application to the State Housing Finance and
Development Corporation (HFDC); and
WHEREAS, Nansay's tax credit application has been approved
by the HFDC Board on May 8, 1992; and
WHEREAS, the opportunity to take advantage of the Federal
and State subsidies for low-income rental units could be lost
unless a multi-family site is designated and made available to
the State's Hawaii Housing Authority by June 19, 1992; and
WHEREAS, the development of low income rental units within
the Waikoloa Affordable Housing Project will be consistent with
the objectives of Section 46-15, HRS; and
WHEREAS, pursuant to Chapter 2, Article 19, Section 2-120,
Hawaii County Code, as amended, Disposition to government,
governmental agencies, non-profit organizations, and affordable
housing developers, the County Council may direct the Finance
Director to dispose of real property in fee, by selling it at
such price and on such terms and conditions deemed proper; and
WHEREAS, the County owns the land herein identified as
Site No. 19; and
WHEREAS, the Hawaii Housing. Authority desires to acquire
Site No. 19 from the County for the purpose of developing low-
income rental housing projects; and
WHEREAS, the aggregate selling price of Site No. 19 is
$1,040,000.00, which includes the parcel's prorated
infrastructure cost ($500,000) and the cost of site improvements
($540,000) necessary to subdivide Site No. 19; and
WHEREAS, the Hawaii Housing Authority is a State Housing
Agency and an "Affordable Housing Developer"; and
WHEREAS, the Office of Housing
desires to negotiate sale terms and
Hawaii Housing Authority; and
and Community Development now
sell Site No. 19 to the
WHEREAS, the metes and bounds description will be
established prior to closing the sale of Site No. 19; and
WHEREAS, Section 46-66, Hawaii Revised States (HRS),
authorizes each County, subject to the approval of its Council,
to grant, sell, or otherwise dispose of any easement for any
public utility purpose by negotiation without public auction; and
WHEREAS, Chapter 2, Article 19, Section 2-lil(a)(2), Hawaii
County Code, as amended, provides that the Council may, by
resolution approved by a majority of its members, direct the
Finance Director or Chief Engineer to grant an easement for
particular purposes, subject, however, to reverter to the County
upon termination or abandonment of the specific purpose for which
it was granted, provided that any easement may be granted by
direct negotiation; and
WHEREAS, the County desires to give the necessary consent to
grant an easement to any public or private utility company which,
in the future, may desire to provide service to the Waikoloa
Affordable Housing Project.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that the Finance Director and Housing Administrator
are hereby directed to negotiate sales terms and sell Site No. 19
to the Hawaii Housing Authority should the agreed to terms
indicate that such sale of real property is in the County's
interest and is consistent with the intent of providing
affordable housing of Hawaii County residents to further the
development of the project.
BE IT FURTHER RESOLVED that in accordance with the provision
of Section 46-66, Hawaii Revised Statutes, and Chapter 2,
Article 19, Section 2-111(a)(2), Hawaii County Code, as amended,
the Director of Finance is authorized to grant easements on
County property to public or private utility companies for the
purpose of providing service to the Waikoloa Affordable Housing
Project, subject however, to reverter to the County upon
termination or abandonment of the specific purpose for which this
easement is granted.
BE IT FURTHER RESOLVED that copies of this Resolution be
sent to the Director of Finance, the Administrator of the Office
of Housing and Community Development, and the Executive Director
of the Hawaii Housing Authority.
